NRC, "Request for Enforcement Discretion Concerning Licensed Operators," dated July 8, 2002 In July 2002, Exelon determined that the requalification program at DNPS did not meet the requirements of 10 CFR 55.59(c) and that 54 licensed individuals at DNPS had not met the requirements of 10 CFR 55.59, paragraphs (a)(1) and (a)(2) because they had not completed the comprehensive written requalification examination required in paragraph (a)(2) within the 24 months required by paragraph (a)(1).

In Reference 1, an exemption was requested from 10 CFR 55.59, paragraph (c)(1) for the facility licensee. Additionally in Reference 2, a formal request for a Notice of Enforcement Discretion was submitted on behalf of the effected licensed operators.

This letter is to inform you that the commitment specified in the above referenced submittals has been completed. As of July 17, 2002, all licensed individuals at DNPS have successfully completed the required written requalification examinations. The 54 licensed individuals who had previously not met the requirements of 10 CFR 55.59 now meet all of the requirements of the requalification program.
