1 RAS 4670 UNITED STATES OF AMERICA DOCKETED 07/23/02 NUCLEAR REGULATORY COMMISSION SERVED 07/23/02 ATOMIC SAFETY AND LICENSING BOARD Before Administrative Judges:

Michael C. Farrar, Chairman Dr. Richard F. Cole Dr. Charles N. Kelber In the Matter of ENTERGY NUCLEAR INDIAN POINT 2, LLC, and ENTERGY NUCLEAR OPERATIONS, INC.

(Indian Point Nuclear Generating Unit No. 2)

Docket No. 50-247-OLA ASLBP No. 02-798-01-OLA July 23, 2002 ORDER (Setting Location and Time for Prehearing Conference)

In a Memorandum and Order issued last week in this license amendment proceeding, we (1) set all matters related to Riverkeepers petition to intervene for a prehearing conference in the White Plains area on Tuesday, August 27, 2002, and (2) indicated we would soon make available information as to precise location, time of day and agenda. To that latter end, this will advise that the prehearing conference will be held at the Hilton Rye Town in Rye Brook, New York (699 Westchester Avenue, phone 914-939-6300). The conference will convene at 9:00 AM and conclude by 1:00 PM (no lunch break will be taken).

Last weeks order set a time frame for filing of pre-conference pleadings such that any extensions of time would likely result in the conference being delayed. Accordingly, if a party anticipates it might be unable to meet the established time frame, any request for a change in schedule should be filed by this Friday, July 26. Any request for an extension filed after that time will be viewed with disfavor.

2 In terms of agenda, the parties may wish to discuss briefly the issue of Riverkeepers standing. The bulk of the time allotted for the parties arguments should be split more or less equally -- depending on the number of contentions filed -- between the late-filed factors and the admissibility of any proposed contention(s).

It is so ORDERED.
