Dear Mr. Keiser:
This letter refers to an investigation completed by the NRC Office of Investigations (OI) on May 17, 2002. This investigation was conducted to determine whether a Nuclear Technical Supervisor, Radiation Protection, deliberately submitted an adulterated urine sample on February 13, 2002, during a random fitness for duty (FFD) drug screening examination while employed by PSEG Nuclear LLC at the Hope Creek Nuclear Generating Station. The investigation was initiated after you identified the misconduct, investigated the matter, and terminated the employment of the supervisor. Based on the evidence developed during its investigation, OI substantiated that the supervisor knowingly adulterated a urine sample for a random FFD drug test by adding bleach to the sample. A synopsis from the investigative report is enclosed.
With respect to this matter, you took actions in accordance with your policies, procedures, the requirements of your FFD program, and 10 CFR Part 26 regulations. You identified that the urine sample contained bleach and you required the supervisor to provide a second witnessed urine sample. You interviewed the supervisor, who admitted to (1) adding bleach to the urine sample and (2) using an illegal drug (marijuana) several days earlier. You subsequently performed an investigation of this matter and then terminated the supervisors employment.
Based on the above, the NRC has determined that you properly implemented your Part 26 program concerning this matter, and no further action by the NRC is warranted. Therefore, no response to this letter is required. In accordance with 10 CFR 2.790 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publically Available Records (PARS) component of the NRCs document system (ADAMS). Enclosure SYNOPSIS On March 2, 2002, the Nuclear Regulatory Commissions (NRC) Office of Investigations (OI),
Region I (RI), initiated this investigation to determine whether a former non-licensed Nuclear Technical Supervisor (NTS) deliberately submitted an adulterated urine sample during a random drug screen examination on February 13, 2002.
Based on the evidence developed during this investigation, OI substantiated that the former NTS knowingly adulterated a urine sample for a random drug test on February 13, 2002.
