Motion For Reconsideration

Dear Ms. Freehand:

The Commission has received your "Motion for Reconsideration," dated April 29, 2002, which we construe as a request to reconsider the decision set forth in my letter of March 28, 2002. In that letter, the Commission denied your request to reopen the 1983 special proceedings that it had initiated concerning various aspects of the Indian Pont facility, including emergency evacuation planning and preparedness.

As I indicated in my letter of March 28, 2002, once the Commission has taken an action that closes a proceeding and the time for judicial review has expired, the proceeding is at an end and petitions to reopen the proceeding will not be entertained. There is no basis to "reconsider" that basic fact and therefore the Commission has denied your request.
