Dear Mr. O'Connor:

The NRC recently completed an investigation that was initiated to determine if a support manager was the subject of discrimination for raising safety issues at the Fermi Nuclear Power Plant. Based on the evidence developed during the investigation, we did not substantiate that the support manager was the subject of discrimination. A copy of the Office of Investigations (01) synopsis is attached.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter, its enclosure, and your response, if any, will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). ADAMS is accessible from the NRC Web site at http:l/www.nrc.aov/NRC/ADAMS/index.html (the Public Electronic Reading Room).

SYNOPSIS This investigation was initiated on June 25, 2001, by the U.S. Nuclear Regulatory Commission, Office of Investigations, Region III, to determine if a-support manager was discriminated against at the Fermi Nuclear Power Plant (Fermi) for raising design deficiency concerns.

Based upon the evidence developed, this investigation did not substantiate the allegation that a support manager was discriminated against at Fermi for raising design deficiency concerns.
