DONALD C. COOK NUCLEAR PLANT, UNITS 1 AND 2 - WITHDRAWAL OF REQUEST FOR EXEMPTION FROM 10 CFR 50.82(a)(8)(i) and (ii)

(TAC NOS. MB3256 AND MB3257)

Dear Mr. Bakken:

By letter dated October 4, 2001, pursuant to 10 CFR 50.12, Indiana Michigan Power Company, the licensee for Donald C. Cook Nuclear Plant (D. C. Cook), Units 1 and 2, requested approval of a exemption from the provisions of 10 CFR 50.82(a)(8)(i) and (ii) which restrict the withdrawal of funds from trusts containing Nuclear Regulatory Commission (NRC)-required decommissioning funds until after permanent plant shutdown. Specifically, the licensee was seeking to withdraw funds which were collected for, and will be used to finance, disposal of the steam generator lower assemblies that were removed from D. C. Cook Unit 1 during the steam generator replacement project in 2000.

In a telephone conference, Mr. Gordan Arent of your staff informed the NRC that the exemption is no longer requested. Therefore, your proposed exemption is considered to be withdrawn. If this information is not correct, please notify the NRC of your intended actions within 10 days of receipt of this letter.
