PETITION TO INTERVENE IN A PROCEEDING ON INDIAN POINT, UNIT 2, SUBMITTED BY RIVERKEEPER, INC Attached is a petition to intervene dated March 18, 2002, and submitted by Riverkeeper, Inc. (ADAMS Accession No. ML020940741). The petition was submitted in response to a notice of no significant hazzards consideration determination made by the NRC staff with respect to a proposed license amendment for Indian Point Unit 2 (Docket No. 50-247). The proposed amendment would make a one time change to the Technical Specifications for containment leak rate testing by increasing the interval of testing from once per 10 years to once per 15 years. The notice was published in the Federal Register at 66 Fed. Reg. 44161, 44165 (August 22, 2001). Although the Federal Register notice providing an opportunity for intervention was published in August, 2001, I am advised that because the staff has not issued the amendment, there is still a proceeding in existence.

The request for hearing is being referred to you for appropriate action in accordance with 10 C.F.R. §2.772(j). Also attached for your consideration are a letter dated April 1, 2002, from Janice E. Moore, Assistant General Counsel for Reactor Programs, submitted in response to the petition and an e-mail copy of a response to the petition submitted on behalf of the licensee.
