n February 26, 2002, the Nuclear Regulatory Commission issued Orders to all 104 commercial nuclear power plants to implement interim compensatory security measures for the generalized high-level threat environment.
NRC required licensees to provide NRC with a schedule for achieving full compliance within 20 days of the Order. Licensees were also required to notify NRC within 20 days of the Order, and justify in writing, if they are unable to comply with any of the requirements of the Order, if compliance with any requirement is unnecessary in their specific circumstances, or if implementation of any requirement would cause the licensee to be in violation of the provisions of any Commission regulation or the facility license, or adversely impact safe operation of the facility.
As you know, New York State has taken an active role in supporting implementation of heightened security at the operating nuclear power plants in the State following the September 11, 2001 terrorist attacks. National Guard troops have been deployed to each site to strengthen perimeter defenses and supplement existing security forces. The State's new Office of Public Security sponsored an evaluation of security at the Indian Point plants by experts from the Federal Bureau of Investigation and shared the results of that evaluation with Region I. The New York State Department of Public Service, in cooperation with the Office of Public Security, is currently reviewing security at the other four plants in the State.
In this regard, I hereby request copies of the responses to the above cited Orders the NRC has received from the nuclear power plants in New York State, specifically, the Indian Point, Nine Mile Point, FitzPatrick and Ginna nuclear power plants. We certainly appreciate the sensitivity of this information and agree to fully protect it as we have other safeguards information provided to this office since the September 11 events. This information will be shared on a need-to-know basis only. At this time, we anticipate sharing this information with the New York State Office of Public Security, the New York State Department of Public Service and the New York State Emergency Management Office.
