SUMMARY
DISPOSITION FILINGS ON UTAH CONTENTION SECURITY J Pursuant to the February 22,2002 order1 of the Atomic Safety and Licensing Board
("Licensing Board" or "Board"), Applicant Private Fuel Storage ("Applicant" or "PFS"), the Nuclear Regulatory Commission Staff ("NRC Staff'), and the State of Utah ("State7') propose the following schedule for the filing of motions for summary disposition and responses thereto with respect to Utah Contention Security J:
- 1.
The Applicant will file its Motion for Summary Disposition on or before May 10,2002.~
- 2.
The State will file its response to Applicant's Motion for Summary Disposition and any cross-motion for summary disposition that it intends to file on or before May 3 1,2002.
- 3.
The NRC Staff will file its response to the Applicant's motion, and to any cross-motion filed by the State, on or before June 24,2002.
Applicant shall also file its response to any cross motion filed by the State on June 24,2002.
Memorandum and Order (Admitting Contention Security J) LBP-02-07 (Feb. 22,2002).
Currently, the Applicant intends to file its motion substantially in advance of the proposed May 10,2002 date agreed to by the parties. The parties further agree, however, that should the Applicant file its motion before May 10, 2002 as currently planned, it would not advance the above proposed dates for subsequent filings.

The State shall file any reply to the Staffs Response to the Applicant's Motion for Summary Disposition on or before July 12, 2002.
The above schedule was developed based on the current schedule for filing proposed findings of fact and conclusions of law set forth in the Board's Order (General Schedule Revisions) of September 20,2001. Should the current schedule for filing proposed findings of fact and conclusions of law be revised, the parties recognize that the schedule dates proposed above for Utah Contention Security J may also need to be revised in order to avoid overlapping filing deadlines.
The parties appreciate the Board's consideration of their work load by allowing them to submit this proposed joint schedule.
