Since 1980 the State of New York has worked with the federal government and affected county governments to prepare for accidents at federally licensed nuclear power plants. Following guidance regulated by FEMA and the Nuclear Regulatory Commission, the State's Emergency Management Office has worked closely with county governments to develop specific plans to protect public health and safety. All of the state's present plans have received federal approval under the 44 CFR 350 approval process.

Since September 11, there has been great concern about the adequacy of security at plants located in New York, particularly at the Indian Point Site in Westchester County. Shortly after the September 11 tragedy, I provided National Guard troops to supplement the security provided by plant operators and local governments at all of the nuclear sites in the State. In early November, James Kallstrom and the State's Office of Public Security conducted a review of the physical security at Indian Point. Building on the foundation of their work, I request that FEMA and the NRC review the Office's findings and explore additional measures to ensure the security of Indian Point and other nuclear facilities in New York State.

I am aware that the NRC is currently reviewing emergency response capabilities nationwide to determine if they are adequate to fully protect public health and safety. I urge you to expedite your efforts to ensure that all nuclear plants across the nation have the training, equipment and procedures needed to ensure the highest level of safety for their workers and the surrounding communities. Because of the proximity of the Indian Point facility to New York City, as well as the recent threat warnings announced by the federal government, I respectfully request that the NRC and FEMA prioritize consideration of security and safety issues particular to the Indian Point facility.

Specifically, a review of the adequacy of the existing federal management of offsite safety and evacuation planning. I am requesting that FEMA and NRC work quickly to review the current standards, guidance and regulations first developed in 1980 to ensure their adequacy on a statewide and nationwide basis.
