Nuclear Energy Institute (NEI), Southern Nuclear Operating Company (SNC), Florida Power and Light Company (FPL), Virginia Electric and Power Company (VEPCO), Duke Energy Corporation (Duke), and Exelon Generation Company (Exelon)
SUBJECT:
SUMMARY
OF LICENSE RENEWAL MEETING BETWEEN THE U.S.
NUCLEAR REGULATORY COMMISSION (NRC) STAFF AND THE NEI LICENSE RENEWAL WORKING GROUP; SNC FOR HATCH NUCLEAR PLANT, UNITS 1 AND 2; FPL FOR TURKEY POINT, UNITS 3 AND 4; VEPCO FOR THE SURRY AND NORTH ANNA POWER STATIONS, UNITS 1 AND 2; DUKE FOR THE MCGUIRE AND CATAWBA NUCLEAR STATIONS, UNITS 1 AND 2; AND EXELON FOR THE PEACH BOTTOM ATOMIC POWER STATION, UNITS 2 AND 3 A joint meeting was held on January 8, 2002, to discuss the status of license renewal activities.
The meeting began with discussions between the NRCs License Renewal Steering Committee (LRSC) and NEIs License Renewal Working Group on the general status of license renewal applications and generic license renewal activities. The meeting continued with discussions between NRC management and SNC (Hatch), FPL (Turkey Point), VEPCO (Surry and North Anna), Duke (McGuire and Catawba), and Exelon (Peach Bottom) regarding the progress of the license renewal application reviews. The meeting agenda and the NRC staffs presentation materials are contained in Attachment 1. Attendees at the meeting are listed in Attachment 2.
Following is a summary of the discussions at the meeting:
I.
Meeting between the NRC License Renewal Steering Committee (LRSC) and NEI License Renewal Working Group A. Status of applications FPL, VEPCO, Duke, and Exelon provided summaries of the Turkey Point, Surry, North Anna, McGuire, Catawba, and Peach Bottom license renewal application reviews, which were subsequently discussed in more detail during the management portion of the meeting (see summaries below). FPL also stated that it had submitted the St. Lucie, Units 1 and 2, license renewal application on November 30, 2001. SNC reported that the renewed licenses for Hatch, Units 1 and 2, were issued on January 7, 2002.
B. License renewal interest - known submittals Page 1 of Attachment 1 shows the latest information the NRC has regarding licensee plans for submitting license renewal applications. No changes to the submittal plans shown were identified at the meeting.
C. License renewal implementation guidance development The staff stated that what have been referred to as emerging issues and generic renewal issues are really lessons learned from the ongoing reviews that need to be pursued as potential improvements in the renewal implementation guidance (Page 2 of Attachment 1). The resolution of these lessons learned will result in changes, as applicable, to the license renewal standard review plan (SRP) (NUREG-1800), Generic Aging Lessons Learned (GALL) Report (NUREG-1801), Regulatory Guide 1.188, or NEI 95-10. Formal revisions to the documents would be issued after a sufficient number of changes have been accumulated to warrant the revision. Until then, the new guidance that is established would be made available for use by applicants and other stakeholders. The staff and industry need to improve the process for identifying lessons learned, resolving disputes, and making decisions on whether the guidance needs to be revised. Currently, the number of issues is small and there is good dialogue between the staff and industry.
NEI requested if the staff could identify in advance the topics and schedules for issuing proposed new guidance. The staff agreed to investigate a method for notifying the industry and other interested stakeholders of new guidance it is planning on issuing.
D. Lessons learned from application reviews (1) Environmental scoping meeting open house experience The NRC staff conducted open houses before the Turkey Point public environmental scoping meetings to provide people with an opportunity to obtain information on the license renewal process and to ask the NRC staff questions that they might not want to raise during the formal scoping meeting. In response to industry questions, the NRCs intent for the open houses and its plans for future meetings were discussed at the September 19, 2001, LRSC-NEI meeting.
As agreed on September 19, the results of the open houses for the VEPCO, Duke, and Exelon applications were discussed at this meeting. NEI indicated that the industry better understands now the staffs plans for the open houses, that they are being conducted well, and they have no further comments. The staff sees benefits from holding the open houses and plans to continue them.
(2) License renewal appeals process As promised at the September 19, 2001, LRSC-NEI meeting, NEI submitted by letter dated December 4, 2001, a proposed license renewal technical issue appeal process. The staff commented that the process starts at a higher level than expected with the process beginning with the Executive Director for Operations appointing a review board. NEI responded that they did not expect the process to be used that often and that most of the disagreements would be resolved at the staff level. However, the industry is open to discussing alternative processes that would provide the independence that they believe is necessary. The industrys concerns with the appeals process as used on Hatch was that the issues being appealed were heard by the managers who were involved with the staff in developing the positions. The staff understands the industrys concerns regarding the need for independence and stated that they would investigate similar processes within the NRC and respond to NEIs proposal.
(3) New lessons identified No new lessons or issues were discussed.
E. Summary NEI stated that there is significant industry interest in license renewal and that the meetings between the LRSC and working group are beneficial. After discussion, the LRSC and NEI agreed to adjust the schedule for the meetings from bi-monthly to quarterly.
F. Public participation No member of the public chose to participate in the meeting.
II. Meetings between NRC Management and License Renewal Applicants A. Florida Power and Light Company -- Turkey Point 3 & 4 The NRC staff presented the status of its review of the Turkey Point license renewal application. The staffs presentation materials are contained in Pages 3 and 4 of Attachment 1 and FPLs in Attachment 3.
The review schedule for the application was discussed. It was noted that the next milestones for the safety review are the issuance of the SER by February 28, 2002, and the Advisory Committee on Reactor Safeguards (ACRS) subcommittee and the full committee meetings on March 13, 2002, and April 11, 2002 respectively. The staff also noted that the applicant has responded to all open items identified in the safety evaluation report. With respect to the final inspection at the site, the staffs view is that another inspection is not needed, and will make that recommendation to the Region II staff and management. Regarding the station blackout issue, the staff stated that this issue has not been raised during the Turkey Point review because there is no final agreement on the final position as yet. No other technical issues were raised.
B. Virginia Electric and Power Company -- Surry 1 & 2 and North Anna 1 & 2 VEPCO provided an update of the progress of the Surry and North Anna license renewal application reviews (Attachment 4). The applicant stated that communication continues to be frequent and productive. The applicant also discussed the categorization of the balance of the requests for additional information (RAIs) received since the last meeting and identified very few concerns. Although the Surry and North Anna applications were prepared and submitted prior to the issuance of SRP and GALL report, VEPCO noted that in a couple cases, RAIs requested consistency with the GALL report for selected aging management programs. The NRC staff indicated that it was aware of the mis-application of the GALL report and was taking corrective action to preclude similar occurrences for VEPCO, as well as other renewal applicants. The applicant also stated that they categorized one RAI as a "Challenge to the Adequacy of the Current Licensing Basis." This RAI relating to station blackout was discussed in the previous meeting between the staff and industry and is currently being addressed as a generic renewal issue between the staff and NEI.
In its closing remarks, VEPCO acknowledged that the review schedule had been accelerated to accommodate multiple concurrent staff application reviews and indicated that the safety and environmental reviews are going well, and are meeting the accelerated schedule.
The staffs presentation materials are contained on Pages 5 and 6 of Attachment 1. No petitions to intervene were received in response to the notice of opportunity for hearing. The staff indicated that the environmental and safety review RAIs have been issued on or ahead of schedule and that the applicants responses to the environmental RAIs have already been received by the staff, ahead of schedule. They also indicated that some of the responses to the safety RAIs have been received and that the applicant indicated that the balance of RAI responses will be forwarded to the staff on or ahead of schedule.
C. Duke Energy Company -- McGuire 1 & 2 and Catawba 1 & 2 The NRC staff stated that communications with Duke were good and summarized the accomplishments of the review to date (see Pages 7 and 8 of Attachment 1). Dukes presentation materials are contained in Attachment 5. The staff noted that a pre-hearing conference had been conducted in Charlotte to allow petitioners Nuclear Information &
Resource Service and the Blue Ridge Environmental Defense League an opportunity to address the responses to their filed contentions from Duke and the NRC staff. A decision regarding standing and the contentions was expected by January 23, 2002 (the Atomic Safety and Licensing Board Panel subsequently issued its order on January 24). The next major milestone is the issuance of all RAIs pertaining to the staffs safety review.
Duke indicated that good, continuous communications continue to advance the application review and commended the staff on the thoroughness of its review, as evidenced by the questions discussed during pre-RAI conference calls. Duke also stated that the Catawba and McGuire site visits and public meetings associated with the environmental reviews were successful, and that Duke was preparing its responses to RAIs pertaining to the staffs review of the environmental reports.
D. Exelon Generation Company -- Peach Bottom 2 & 3 The NRC staff and Exelon noted the accomplishments for the review of the Peach Bottom renewal application. The staffs presentation materials are contained in Pages 9 and 10 of and Exelons in Attachment 6. All milestones have been met and communications between the staff and Exelon have been good. Upcoming activities include Exelon responding to the staffs environmental RAIs and the issuance of the staffs safety RAIs.
Exelon expressed its concern that emerging industry issues may be challenging the stability and predictability of the license renewal process to an extent that may impact on the Peach Bottom review schedule. Exelon was also concerned that the NRC staff may have a misunderstanding regarding the application of the GALL programs. Specifically, Exelon is concerned that some staff reviewers expect the applicant to apply all programs identified in GALL to manage aging effects. As previously discussed under Item I.C, the staff is continuing to discuss with the industry the resolution of the emerging issues.
