SUMMARY

FOR THE DECEMBER 12, 2001, PUBLIC MEETING BETWEEN THE NRC AND VIRGINIA ELECTRIC POWER COMPANY, DUKE ENERGY CORPORATION, EXELON CORPORATION, AND NUCLEAR ENERGY INSTITUTE REGARDING LICENSE RENEWAL EMERGING ISSUES On Wednesday, December 12, 2001, the NRC staff met with Virginia Electric Power Company (VEPCO), Duke Energy Corporation (Duke), Exelon Corporation (Exelon), and the Nuclear Energy Institute (NEI) in a public meeting on license renewal emerging issues. Attached are the agenda (Attachment 1), two handouts provided by the industry (Attachments 2 and 3), and the list of attendees (Attachment 4).

The meeting was conducted in accordance with agenda provided in the meeting notice. The meeting began with the three applicants briefly describing its observations (refer to Attachment 2). In general, the applicants identified concerns regarding emerging technical issues, changes in staff positions, and communications. The applicants also specifically discussed four of the five emerging issues identified in the meeting agenda. Fire protection scoping was not discussed because the staff has not yet issued its position on this subject.

NEI followed with discussions on guidance documents and the technical appeals process (refer to Attachment 3). NEI briefly discussed the guidance documents and the need to incorporate lessons learned. NEI then outlined an appeals process recommended by the industry. The staff agreed to formally respond to the appeal process presented during this meeting.

The staff responded to the applicants observations. The staff emphasized the need to identify emerging issues and include them within the scope of license renewal when applicable. The staff also addressed the need to change or enhance staff positions as new information becomes available to ensure consistency with the rule. Finally, the staff emphasized the need for continuous communication throughout the license renewal process, and the need for an applicant to identify when additional dialogue is needed on any matter that is not clear.

After the generic discussions, VEPCO was given an opportunity to discuss its specific position on station blackout. An open discussion took place that involved many of the attendees beyond the staff and VEPCO. It became clear that both the industry and staff needed additional discussion on this matter and it was decided that another public meeting was needed on this subject. That meeting was scheduled for January 10, 2002.

Throughout the discussions described above, the public was given an opportunity to comment on the information exchanged. Members from the Nuclear Information and Resource Service, as well as other members of the public participated in the meeting. No specific comments relating to the topics and the level of discussions were identified by the public.
