COOPER NUCLEAR STATION - ISSUANCE OF AMENDMENT REGARDING CORRECTIONS OF ERRORS IN TECHNICAL SPECIFICATIONS (TAC NO. MB2004)
Dear Mr. Wilson:
The Commission has issued the enclosed Amendment No. 191 to Facility Operating License No. DPR-46 for the Cooper Nuclear Station (CNS). The amendment consists of changes to Technical Specification Table 3.3.1.1-1, (1) to correct typographic errors, and (2) to delete the fixed portion of the allowable value in TS Table 3.3.1.1-1, function 2.b, in response to Nebraska Public Power District (the licensee) application dated May 9, 2001, as supplemented by e-mail dated February 28, 2002.
The licensees application of May 9, 2001, erroneously described change (2) as correction of an error, when it was a request for change. By an electronic mail dated February 28, 2002, the licensee provided a correction to its May 9, 2001, request. The NRC staff has reviewed the revised change (2), and finds it acceptable.
Additionally, the licensee has provided revised Technical Specification Bases pages for incorporation in the CNS Bases document. The Nuclear Regulatory Commission staff noted an error in the Technical Specification Bases pages and discussed it with the licensee by telephone on November 28, 2001. The licensee provided corrected Bases pages by electronic mail dated November 28, 2001. The corrected Bases pages are included in this amendment.
A copy of our related safety evaluation is also enclosed. The Notice of Issuance will be included in the Commission's next biweekly Federal Register notice.

The Nuclear Regulatory Commission (the Commission) has found that:
A.
The application for amendment by Nebraska Public Power District (the licensee),
dated May 9, 2001, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commissions rules and regulations set forth in 10 CFR Chapter I; B.
The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C.
There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commissions regulations; D.
The issuance of this license amendment will not be inimical to the common defense and security or to the health and safety of the public; and E.
The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commissions regulations and all applicable requirements have been satisfied.

Accordingly the license is amended by changes to the Technical Specifications as indicated in the attachment to this license amendment and Paragraph 2.C.(2) of Facility Operating License No. DPR-46 is hereby amended to read as follows:

Technical Specifications The Technical Specifications contained in Appendix A, as revised through Amendment No. 191, are hereby incorporated in the license. The Nebraska Public Power District shall operate the facility in accordance with the Technical Specifications.
3.
The license amendment is effective as of its date of issuance and shall be implemented within 30 days from the date of issuance.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO. 191 TO FACILITY OPERATING LICENSE NO. DPR-46 NEBRASKA PUBLIC POWER DISTRICT COOPER NUCLEAR STATION DOCKET NO. 50-298
1.0 INTRODUCTION
By letter dated May 9, 2001, as supplemented by e-mail dated February 28, 2002, the Nebraska Public Power District (licensee) proposed changes to correct two errors in Cooper Nuclear Station (CNS) Technical Specifications (TSs); and to remove references to flow biased high flux clamp in Table 3.3.1.1-1 and the TS Bases. A Flow Biased High Flux clamp does not exist at CNS. The e-mail supplement of February 28, 2002, provided clarifications, which did not alter the conclusions regarding no significant hazards considerations.
Specifically, the licensee proposes to delete the words "and < 119.0% RTP" from the ALLOWABLE VALUE column For Table 3.3.1.1-1 Function 2.b (page 3.3-6), and to correct a typographical error for Table 3.3.1.1-1 Function l.b Mode 5 (page 3.3-6). The licensee proposes to replace "3.3.2.2.13" with "3.3.1.1.13." There is no SR 3.3.2.2.13 in the TS.
The licensee will revise the Bases sections to Table 3.3.1.1-I as follows. For Bases B 3.3.1.1 function 2.b (page B 3.3-8), the licensee will delete the end of the second sentence starting with the words "but is clamped..." For Bases B 3.3.1.1 function 2.b (continued) (page B 3.3-10), the licensee will delete the entire first paragraph.
2.0 EVALUATION The licensee proposes to correct the errors in TS Table 3.3.1.1-1 and correct the appropriate sections of the Bases as follows.
In Table 3.3.1.1-1 Function 2.b (page 3.3-6), the licensee proposes to delete the words "and 119.0% RTP" from the ALLOWABLE VALUE column. The licensee states that by application dated December 16, 1999, it requested revision to the flow-biased value of the APRM setpoint. The flow-biased value was raised to 0.66W+71.5% RTP. The fixed portion of the allowable value and 119.00% RTP should have been deleted, but was not deleted from the TS page 3.3-6 in the application. The NRC staff approved the raised flow-biased value including the fixed value (and 119.0% RTP) in Amendment 184. Since the licensees request to raise the APRM setpoint value to 0.66W+71.5% RTP was approved in Amendment 184, the NRC staff finds the deletion of the fixed value (and 119.0% RTP) is acceptable.
The staff noticed an error in the footnote of TS Page 3.3-6. The footnote (b) did not show the correct bracket. The staff discussed this error with the licensee and corrected the footnote (b) on page 3.3-6.
Also in Table 3.3.1.1-1 Function l.b Mode 5 (page 3.3-6), the licensee proposes to replace "3.3.2.2.13" with "3.3.1.1.13." The NRC staff finds this change acceptable because the surveillance requirements listed in Table 3.3.1.1-1 reference LCO 3.3.1.1 not LCO 3.3.2.2 in CNS TS.
The licensee is revising the Bases pages B 3.3-8 and B 3.3-10 to delete the reference to Flow Biased High Flux clamp. Such a clamp does not exist at CNS. For Bases B 3.3.1.1 function 2.b (page B 3.3-8), the licensee will delete the second sentence starting with words, "but is clamped..." On Bases B 3.3.1.1, under function 2.b (continued) (page B 3.3-10), the licensee will delete the entire first paragraph.
The NRC staff noted that the paragraph at the bottom of the page B 3.3-9 was duplicated on page B 3.3-10 in the TS pages submitted by the licensee in its request for amendment. The NRC staff informed the licensee of its error during a telephone call of November 28, 2001. The licensee submitted the corrected TS pages B 3.3-9 and B 3.3-10 electronically. Those pages are included in the amendment.
3.0 STATE CONSULTATION
In accordance with the Commissions regulations, the Nebraska State official was notified of the proposed issuance of the amendments. The State official had no comments.
4.0 ENVIRONMENTAL CONSIDERATION
The amendment changes TSs and corrects typographic errors in a requirement with respect to the installation or use of a facility component located within the restricted area as defined in 10 CFR Part 20. The NRC staff has determined that the amendment involves no significant increase in the amounts and no significant change in the types of any effluents that may be released offsite, and that there is no significant increase in individual or cumulative occupational radiation exposure. The Commission has previously issued a proposed finding that the amendment involves no significant hazards consideration, and there has been no public comment on such finding (66 FR 59509 dated November 28, 2001). Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR Section 51.22(c)(9). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.
5.0 CONCLUSION
The Commission has concluded, based on the considerations discussed above, that (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commissions regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.
