Dear Mr. Beedle:
The purpose of this letter is to respond to your correspondence requesting NRC authorization for NEI to establish the capability to receive and hold safeguards information (SGI), dated October 31, 2001. Applicable regulatory requirements are found in Title 10 of the Code of Federal Regulations (10 CFR), Part 73, section 73.21, Requirements for the protection of safeguards information and section 73.57, Requirements for criminal history checks of individuals granted unescorted access to a nuclear power facility or access to Safeguards Information by power reactor licensees.
In accordance with a telephone conversation between Dennis Gordon (NRR/DIPM/IRSB), and Richard Enkeboll (NEI), it is the NRCs understanding that NEIs need for authorization to receive and store SGI has been resolved. First Energy, an NRC power reactor licensee, has assigned an employee, Mr. Ronald Rose, to the NEI facility and has established the capability for Mr. Rose to receive and store SGI at his duty location within the NEI facility. Mr. Rose may, in turn, grant NEI personnel access to the SGI materials in his possession in accordance with the requirements of 10 CFR 73.21 and 10 CFR 73.57. As a result, NRC authorization is no longer needed. Therefore, NRR will take no further action regarding this request.
