Dear Mr. Davis:
Thank you for your letter of March 2, 2001, concerning the NRCs ongoing work to re-evaluate the requirements for security programs in 10 CFR 73.55, including NEIs suggestions for modifications to the existing rule language. As requested in your letter, the NRC will consider the comments, and the suggested modifications in the enclosure to your letter, in the rulemaking effort.
The staff is currently circulating the proposed rulemaking for internal comment and concurrence and expects to forward it to the Commission in May 2001, seeking permission to publish the proposed rule in the Federal Register for public comment. Your letter of March 2, 2001, will be added to the public comments, and will be considered at that time.
