Dear Ms. Casey:

I am responding to your undated letter to Carol Ann Reed (received on June 19, 2000), in which you appealed the adequacy of the search for records subject to your Freedom of Information Act (FOIA) request dated June 30, 1999. In our May 23, 2000, response to your FOIA request, we identified and released in part two records subject to your request.

Acting on your appeal, the staff searched again for records subject to your request and the additional records identified on the enclosed appendices were located. The record identified on Appendix A is being released in its entirety. The records identified on Appendix B are being withheld in part. The information is being withheld from public disclosure pursuant to Exemption 7(C) of the FOIA (5 U.S.C.(b)(7)(C)) and 10 CFR 9.17(a)(7)(iii) of the Commissions regulations. Release of information withheld under Exemption 7(C) could reasonably be expected to constitute an unwarranted invasion of personal privacy. No legitimate public interest in the release of this information outweighs the rights of the individuals to privacy. A FOIA requesters private need for information does not justify the public disclosure of private information.

The Appendix A record and the released portions of the Appendix B records are enclosed.

This is the final agency action on these records. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)),

judicial review of this decision is available in a district court of the United States in the district in which you reside or have your principal place of business, or in the District of Columbia.
