DOCKET NOS. 50-266, 50-301, AND 72-005 NOTIFICATION OF INTENT TO COMPLETE TRANSFER OF OPERATING AUTHORITY POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2

Reference:

1. Order Approving Transfer of Operating Authority and Conforming Amendments, Docket Nos. 50-266, 50-301,72-005, May 15, 2000.

The transfer of operating authority approved by Reference 1 was subject to two conditions.

Condition (1) requires in part that:

After receipt of all required regulatory approvals of the transfer of operating authority to NMC, WEPCo and NMC shall inform the Director of the Office of Nuclear Reactor Regulation in writing.. . of the date of the closing of the transfer no later than 7 business days prior to the date of closing.

Wisconsin Electric Power Company (WEPCo) is prepared to transfer operating authority and NMC is prepared to accept the operating authority for the Point Beach Nuclear Plant. The transfer of operating authority is expected to take place on Monday, August 7, 2000. WEPCo respectfully requests that the NRC issue the conforming license amendments necessary to support the operating authority transfer to the NMC and that those amendments be made effective on August 7, 2000.

The need for completion of the transfer of operating authority on August 7, 2000, thus providing less than the seven working day notice requested by the NRC in Reference 1, was discussed with the NRC Staff by telecom on August 4, 2000.

NPL 2000-0353 August 7, 2000 Page 2 Condition (2) of Reference 1 requires that:

NMC shall, prior to completion of the transfers of operating authority for Point Beach, provide the Director of the Office of Nuclear Reactor Regulation satisfactory documentary evidence that NMC has obtained the appropriate amount of insurance required of licensees under 10 CFR Part 140 of the Commission's regulations.

The documentary evidence of insurance has been provided by separate letter from the NMC to the NRC dated August 4, 2000.

This letter contains no restricted or other defense information.
