In accordance with 10 CFR 52.35, Use of site for other purposes, PSEG Nuclear LLC (PSEG) hereby informs the NRC of a planned significant use of the site subject to Early Site Permit (ESP) No. ESP-005 (Reference 1), for a purpose other than those described in the ESP.
Specifically, PSEG has entered into a lease agreement with the State of New Jersey Economic Development Authority (NJEDA), to enable the development of an Offshore Wind Marshalling Port facility using property subject to PSEGs ESP. PSEG considers the New Jersey Wind Port (NJWP) Project to be compatible with potential future nuclear development based on the scope and scale of development associated with the facility. The NJWP project is not specifically addressed in PSEGs ESP. Therefore, development of the project invokes the reporting requirements of 10 CFR 52.35 to notify the Director, Office of Nuclear Reactor Regulation, of any significant uses of the site for purposes other than those described in the ESP at least 30 days in advance of actual construction or site modification for the activities.
As identified in 10 CFR Part 52, an ESP is an NRC-approved assessment of the environmental and safety attributes of a specific site as being acceptable for potential construction and operation of one or more nuclear reactors. The ESP is intended to be referenced as part of a potential future Combined License Application (COLA), which, following approval by the NRC, permits the construction and operation of a nuclear plant at the site. The ESP was issued with
LR-N22-0010 10 CFR 52.35 Page 2 an expiration date of May 5, 2036. In accordance with 10 CFR 52.29 and 52.33, PSEG may apply to the NRC for renewal of the ESP for intervals of up to 20 years at a time.
The NJWP Project team has initiated early site exploration and preparation activities such as environmental testing, test piles, clearing, grubbing, debris removal, grading, excavation, and preparation of borrow areas to provide construction material for future use. PSEG expects NJWP construction activities on the ESP site to commence in the June to July 2022 timeframe.
The NJWP will primarily consist of an extended shoreline docking facility located adjacent to an open area in which offshore wind turbine components will be staged and processed onto ships for transport out to sea for assembly. Small buildings/office structures may also be erected on the site to support port operations. PSEG does not consider the NJWP facility to constitute a use of the site that would invalidate the safety or environmental conclusions reached in the ESP or irreversibly preclude potential future development of the site for a nuclear power plant. In the event PSEG elects to renew the ESP or move forward with submittal of a COLA or construction permit application referencing the ESP, the details within the ESP on which the NRC based its safety and environmental conclusions will be validated and/or updated as necessary to address the use of the area for the NJWP facility.
