The permit was issued to St. Lucie County, not FPL; however, since this matter affects the St.

Lucie cooling water discharge canal, the permit is being provided to the NRC for information.

The permit application was issued to St.

Lucie County by the Florida Department of Environmental Protection (FDEP) on June 12, 1997.

By letter, L-97-71 dated March 26, 1997, Florida Power &; Light Company provided the NRC an information copy of the St. Lucie County permit application for the South Hutchinson Island WWTF. Our letter provided the bases for the determination that since the operational use of the plant outfall by the County relates to water quality issues requiring Wastew'ater Permit approval from FDEP, it is exempt from the Environmental Protection Plan, Section 3.1, review.

The above named permittee is hereby authorized to operate the facilities shown on thc application and other documents attached hereto or on filewith the Department and made a part hereof and specifically described as follows:

TREATMENT FACILITIES:

A new 1.6 MGD maximum month average daily flow(MMADF)extended aeration facilitydesigned with Class I reliability. The WWTF consists ofthe followingmajor treatment, disposal components and associated facilities:.

(1) Preliminary treatment (headworks) structure includes mechanically cleaned bar screen with 1/4-inch spacing; forced vortex grit collector; two (2) (one as stand-by) grit pumps each rated at approximately 200 gallons per minute (gpm); and a grit cyclone washer/separator.

The entire headworks is enclosed with gases treated by a serpentine scubber rated at 1,500 cubic feet per minute (cfm).

(2) Four (4) aeration basins each with a volume of350,625 gallons, for a total volume of 1.403 million gallons (MG). Airis supplied by two (2) 150 horsepower (hp)(one in standby) and one (1) 100 hp centrifugal blowers each rated at approximately 2,200 cfm at 7.3 pounds per square inch (psi) through a fine bubble ceramic diffuser system installed across the entire bottom ofthe basins.

Individual aeration basins can be isolated and removed from service during low flow periods.

Two (2), 75 foot diameter secondary clarifiers with a total surface area of8,836 square feet (sq. ft.)

and a total weir length of445 feet. Three (3) (one as stand-by) return activated sludge pumps each rated at

(4) Two (2), 36 foot long by 12 foot wide tertiary filters with automatic backwash traveling bridge, a total filterarea of864 sq. ft., two (2) feet offiltermedia, and four (4) (one as stand-by) filterbackwash and wash water pumps each rated at approximately 320 gpm.

(5) Standby chemical feed facilities to enhance filtration includeq two (2), in-line static mixers for polymer blending, two (2) polymer activation units and two (2) (one as stand-by) polymer feed pumps each rated at approximately five (5) gallon per hour (gph).

(6) Chlorine contact tank with two (2) 40 foot long by 15 foot wide by 10 foot deep compartments, with three (3) channel per compartment and a total volume of89,760 gallons. A chlorine building which houses chlorine contains, load scales, automatic switch over and injection devices. The chlorination system is designed to provide high-level disinfected reclaimed water for reuse.

(7) Atwo (2.0) MG storage tank to store high-level disinfected reclaimed water for off-site reuse.

(8) An effluent transfer pump station downstream ofthe chlorine contact tank which houses three (3) (one as stand-by) reclaimed water transfer pumps (to storage tank) each rated at approximately 1,750 gpm, and two (2) (one as stand-by) on-site reuse pumps each rated at 150 gpm. The reclaimed water transfer pumps can also discharge to the alternate effluent disposal (outfall) main.

(9) A reclaimed water distribution system pump station downstream ofthe reclaimed water storage tank which houses three (3) (one as stand-by) reclaimed water high service pumps (to off-site reuse) each rated at approximately 1,750 gpm. The high service pumps can also discharge to the alternate disposal (outfall) main.

(10)A dechlorination system which includes a flow meter/monitor, a chlorine residual analyzer, a sodium bisulflte injection system with (2) (one as stand-by) chemical feed pumps each rated at approximately five (5) gph and a downstream manual sampling point.

(11) Two (2) 22.5 foot long by 22.5 foot wide by ten (10) foot deep waste residuals holding/stabilization tanks'equipped with propeller type mixers. Lime stabilization equipment includes a lime silo, lime slacker, and two (2) (one as stand-by) lime surry feed pumps each rated at approximately 30 gpm. Two (2) blowers each rated at approximately 500 cfm willremov'e the gases from these tanks and discharge them into the aeration basin through a separate diffuser system.

EFFLUENT DISPOSAL:

Surface Water Discharge: A new 1.6 mgd MMADFpermitted discharge to Florida Power and Light St.

Lucie Nuclear Power Plant cooling water discharge canal, is mixed with FP&L's minimum 100 MGD discharge to the Atlantic Ocean (Class IIImarine waters) at Discharge Location (D001) which is approximately 1,400 feet in length and discharges at a depth ofapproximately 12 feet. The point of discharge is located approximately at latitude 27'1'2" N, longitude 80'4'7" W.

Effluent samples shall be taken at the monitoring site locations listed in Permit Condition I.

Recording flowmeters and totalizers shall be utilized to measure flowand calibrated at least annually. (62-601.200(17) and.500(6), 5-31-93J 5.

The arithmetic mean ofthe monthly fecal coliform values collected during an annual period shall not exceed 200 per 100 mL of effluent sample.

The geometric mean ofthe fecal coliform values for a minimum of 10 samples ofeffluent each collected on a separate day during a period of30 consecutive days (monthly), shall not exceed 200 per 100 mL of sample. No more than 10 percent ofthe samples collected (the 90th percentile value) during a period of30 consecutive days shall exceed 400 fecal coliform values per 100 mL ofsample.

Any one sample shall not exceed 800 fecal coliform values per 100 mL ofsample. Note: To report the 90th percentile value, list the fecal coliform values obtained during the month in ascending order. Report the value ofthe sample that corresponds to the 90th percentile (multiplythe number ofsamples by 0.9). For example, for 30 samples, report the corresponding fecal coliform number for the 27th value ofascending order. (62-600.440(4)(c), 6-8-93J 6.

A minimum of0.5 mg/L total residual chlorine must be maintained for a minimum contact time of 15 minutes based on peak hourly flow. (62-600.440(4)(b), 6-8-93J 7.

Whole ENuent ToxicityTesting The permittee shall initiate the series oftests described below beginning on issuance date and lasting through the expiration date to evaluate whole eNuent toxicityofthe discharge from the dechlorinated eNuent being discharged to FPL cooling canal. Alltest species, procedures and quality assurance criteria used shall be in accordance with Methods for Measurin Acute Toxici ofENuents to'Freshwater and Marine Or anisms EPA/600/4-90/027F, or the most current edition. The control water and dilution water used willbe moderately hard water as described in EPA/600/4-90/027F, Table 6, or the most current edition. A standard reference toxicant quality assurance (QA) acute toxicitytest shall be conducted concurrently or no greater than 30 days before the date ofthe "routine" test, with each species used in the toxicitytests.

The results ofall QA toxicitytests shall be submitted with the discharge monitoring report (DMR). Any deviation ofthe bioassay procedures outlined herein shall be submitted in writing to the Department for review and approval prior to use.

The permittee shall conduct 96-hour acute static renewal, multi-concentration (definitive) toxicity tests using the daphnid, Cerioda lrnia duhio, and the bannerfin shiner, ~Crinella lecdsi. Alltests willbe conducted on separate grab samples collected at evenly-spaced (6-hr) intervals not to exceed four (4) grab samples over a 24-hour period. Each sample is to be used in a separate test in order to catch any peaks oftoxicity and to account for daily variations in effluent quality.

7.1.b. If'control mortality exceeds 10% for either species in any test, the test(s) for that species (including the control) shall be repeated.

A test willbe considered valid only ifcontrol mortality does not exceed 10% for either species.

If, in any separate grab sample test, 100%

mortality occurs prior to the end ofthe test, and control mortality is less than 10% at that time, that test (including the control) shall be terminated with the conclusion that the sample demonstrates unacceptable acute toxicity.

7.1.c. All"routine" test shall be conducted using a control (0% effluent) and the followingtest concentrations:

100%, 50%, 25%, 12.5% and 6.25% eftluent.

7.l.d. An LC50 < 100% effluent in any "routine" test or subsequent additional definitive test sample willconstitute a violation ofthese permit conditions, and Rule 62-302.200(1), Rule 62-302.500(1)(d), and Rule 62-4.244(3)(a), F. A. C.

7.2.a. The toxicity tests specified above shall be conducted once per discharge, but not to exceed one "routine" test every two months, until 6 valid tests are completed.

Samples shall be collected only during actual discharge events.

These tests are referred to as "routine".tests.

Upon the completion ofsix valid tests which demonstrate that no unacceptable toxicity (as defined in 3.a.) has been identified, the permittee may petition the Department for a reduction in monitoring frequency.

7.2.b. Results from "routine" tests shall include the LC50 values with 95% confidence intervals and be reported according to EPA/600/4-90/027F, Section 12, Report Preparation (or the most current edition), and shall be submitted to:

Florida Department ofEnvironmental Protection 400 North Congress Avenue West Palm Beach, FL 33401 7.3.a. Ifan acute toxicityviolation (a calculated LC50 < 100% effluent) or moralities ofgreater than 50% in the 100% effluent concentration is found in a "routine" tests, the permittee shall conduct two additional multi-concentration test on each species indicating an acute toxicity violation. The first additional test shall be run within seven days ofthe failed "routine" test.

The second test shall be collected within seven days ofthe first additional test. Each test will include grab samples taken as described in l.a. and run as separate definitive analyses.

Results for each additional test willinclude the determination of LC50 values with 95%

confidence limits. Additionally, a sample ofsufficient size for chemistry analyses shall be taken concurrently with each bioassay sample. Ifthe follow-up bioassay indicates the presence oftoxicity, the chemistry samples shall be run. Ifthe follow-up samples do not indicated the presence oftoxicity, the chemistry samples shall not be run. Chemistry analyses shall include: initial residual chlorine, unionized and ionized ammonia. Ifthe discharge ceases before additional, follow-up test samples can be collected, the follow-up test and companion chemistries shall be collected during the next discharge event(s) until two (2) valid tests are run.

Results from additional tests, required due to acute toxicityviolation in the "routine" tests, shall be submitted in a rcport prepared according to EPA/600/4-90/027F, Section 12, or the most current edition and submitted within 45 days ofcompletion ofeach additional, valid test. Ifthe additional test(s) demonstrate unacceptable acute toxicity, the permittee will meet with the Department within 30 days ofthe report followingthe second follow-up test to identify corrective actions necessary to remedy the observed acute toxicity violations.

S.a The toxicitytests specified above shall be conducted once every two months until 6 valid bimonthly tests.

These tests are referred to as "routine" tests.

Upon the completion ofsix valid tests which demonstrate that no unacceptable toxicity( as defined in 4.a.) has been identified, the permittee may petition the Department for a reduction in monitoring frequency.

8.b. Results from "routine" tests shall be reported according to EPA/600/4-90/027F, Section 13, Report Preparation (or the most current edition), and shall be submitted to:

10.a. Ifacute toxicityviolations are determined in a "routine" test using 100% efIIuent, the permittee shall conduct three additional tests on the specie(s) indicating acute toxicity. The first additional test willinclude four grab samples taken as described in I.a. and run as four separate definitive analyses.

The second and third additional definitive tests willbe run on a single grab sample collected on the same time and day ofthe week as when the greatest level oftoxicity(lowest LC50 or greatest mortality in the initial test) was identified in the four additional tests or the initial screen test, respectively.

10.b. Each additional test shall be conducted using a control (0% effluent) and a minimum offive dilutions: 100%, 50%, 30%, 12.5% and 6.25% effluent and a control (0% effiuent). The dilution series may be modified in the second and third test to more accurately identify the toxicity, such that at least two dilutions above and two dilutions below the target toxicity and a control (0% effluent) are run.

10.c. For each additional test, the sample collection requirements and the test acceptability criteria specified in Section I above must be met for the test to be considered valid. The first test shall begin withintwo weeks ofthe end ofthe "routine" tests, and shall be conducted weekly therea Acr until /hree additional, valid tests are completed. The additional tests willbe used to determine ifthe toxicity found in the "routine" test is still present.

10.d. Results from additional tests, required due to acute toxicityviolation in the "routine" tests, shall be submitted in a single report prepared according to EPA/600/4-90/027F, Section 12,

Upon completion ofthe additional tests, the permittee shall meet with the Department within 30 days ofthe report submittal to identify corrective actions necessary to remedy the acute toxicity violation.

10,e. Chemical analysis for each grab sample shall include: the initial total residual chlorine and the ionized and unionized ammonia for the 100% sample; the salinity ofeach concentration measured at the beginning and end ofthe tests; and pH, dissolved oxygen (DO), and temperature for each replicate taken at 24-hour intervals for each test species.

11. The approved analytical methods and corresponding required MDL(method dctcction limit) and PQL (practical quantification limit)for parameters monitored at Outfall D001 and surface water monitoring contained in Section I.A. are:

Prior to placing the new facilities into operation or any individual unit processes into operation, for any purpose other than testing for leaks and equipment operation, the permittee shall complete and submit to the Department DEP Form 62-620.910(12), Notification of Completion ofConstruction for Domestic Wastewater Facilities. (62-620.630(2), I1-29-94J 2.

The newly constructed Part IIIreuse system shall not be placed in service for any purpose without written approval from the Department.

For projects identified in the permit as being constructed in phases, written permission is only required for the first phase.

Application for approval shall be made to the Department on DEP Form 62-610.300(4)(a)3, Application for Permission to Place a Public Access Reuse System in Operation.

3. 'ithin six months after a facility is placed in operation, the permittee shall provide written certification to the Department on Form 62-620.910(13) that record drawings pursuant to Chapter 62-600, F.A.C., and that an operation and maintenance manual pursuant to Chapters62-600 and 62-610, F.A.C., as applicable, are available at the location specified on the form.

Ifthe permittee wishes to continue operation ofthis wastewater facilityafter the expiration date ofthis permit, the permittee shall submit an application for renewal, using Department Forms62-620.910(1) and (2), no later than one-hundred and eighty days (180) prior to the expiration date ofthis permit. Collection/transmission system overflows shall be reported to the Department in accordance with Permit Condition IX.20. (62-604.550, 5-31-93J (62-620.610(20), 11-29-94J 9.

The operating authority ofa collection/transmission system and the permittee ofa treatment plant are prohibited from accepting connections ofwastewater discharges which have not received necessary pretreatment or which contain materials or pollutants (other than normal domestic wastewater constituents):

a.

Which may cause fire or explosion hazards; or b.

Which may cause excessive corrosion or other deterioration ofwastewater facilities due to chemical action or pH levels; or c.

Which are solid or viscous and obstruct flowor otherwise interfere with wastewater facilityoperations or treatment; or d.

Which result in treatment plant discharges having temperatures above 40'C.

10. The treatment facility,storage ponds, rapid infiltrationbasins, and/or infiltrationtrenches shall be enclosed with a fence or otherwise provided with features to discourage the entry of animals and unauthorized persons.

11. Screenings and grit removed from the wastewater facilities shall be collected in suitable containers and hauled to a Department approved Class I landfillor to a landfillapproved by the Department for receipt/disposal ofscreenings and grit. (62-7.540, 12-10-85J
12. The permittee shall provide adequate notice to the Department ofthe following:

'I a.

Any new introduction ofpollutants into the facilityfrom an industrial discharger which would be subject to Chapter 403, F.S., and the requirements ofChapter 62-620, F.A.C. if it were directly discharging those pollutants; and b.

Any substantial change in the volume or character ofpollutants being introduced into that facilityby a source which was identified in the permit application and known to be discharging at the time the permit was issued.

Any permit noncompliance constitutes a violation ofChapter 403, Florida Statutes, and is grounds for enforcement action, permit termination, permit revocation and reissuance, or permit revision.

Any unauthorized deviations from the approved drawings, exhibits, specifications or conditions ofthis permit constitutes grounds for revocation and enforcement action by the Department.

As provided in Subsection 403.087(6), F.S., the issuance ofthis permit does not convey any vested rights or any exclusive privileges. Neither does it authorize any injury to public or private property or any invasion ofpersonal rights, nor authorize any infringement offederal, state, or local laws or regulations.

This permit is not a waiver ofor approval ofany other Department permit or authorization that may be required for'other aspects ofthe total project which are not addressed in this permit. 'This permit does not relieve the permittee from liabilityand penalties for harm or injury to human health or welfare, animal or plant life, or property caused by the construction or operation ofthis permitted source; nor does it allow the permittee to cause pollution in contravention ofFlorida Statutes and Department rules, unless specifically authorized by an order from the Department.

The permittee shall take all reasonable steps to minimize or prevent any discharge, reuse ofreclaimed water, or residuals use or disposal in violation of this permit which has a reasonable likelihood ofadversely affecting human health or the environment. It shall not be a defense for a permittee in an enforcement action that itwould have been necessary to halt or reduce the permitted activity in order to maintain compliance with the conditions ofthis permit. The permittee, by accepting this permit, specifically agrees to allow authorized Department personnel, including an authorized representative ofthe Department and authorized EPA personnel, when applicable, upon presentation ofcredentials or other documents as may be required by law, and at reasonable times, depending upon the nature ofthe concern being investigated, to:

10. In accepting this permit, thc permittee understands and agrees that all records, notes, monitoring data, and other information relating to the construction or operation ofthis permitted source which are submitted to the Department may be used by the Department as evidence in any enforcement case involving the permitted source arising under the Florida Statutes or Department rules, except as such use is proscribed by Section 403.111, Florida Statutes, or Rule 62-620.302, Florida Administrative Code.

Such evidence shall only be used to the extent that it is consistent with the Florida Rules ofCivilProcedure and applicable evidentiary rules. (62-620. 610(10), 11-29-94J I l. When requested by the Department, the permittee shall within a reasonable time provide any information required by law which is needed to determine whether there is cause forrevising, revoking and reissuing, or terminating this permit, or to determine compliance with the permit. Ifthe permittee becomes aware ofrelevant facts that were not submitted or were incorrect in the permit application or in any report to the Department, such facts or information shall be promptly submitted or corrections promptly reported to the Department.

Unless specifically stated otherwise in Department rules, the permittee, in accepting this permit, agrees to comply with changes in Department rules and Florida Statutes after a reasonable time for compliance; provided, however, the permittee does not waive any other rights granted by Florida Statutes or Department rules. A reasonable time for compliance with a new or amended surface water quality standard, other than those standards addressed in Rule 62-302.500, F.A.C., shall include a reasonable time to obtain or be denied a mixing zone for the new or amended standard.

13. The permittee, in accepting this permit, agrees to pay the applicable regulatory program and surveillance fee in accordance with Rule 62-4.052, F.A.C. (62-620.610(13), II-29-94J
14. This permit is transferable only upon Department approval in accordance with Rule 62-620.340, F.A.C. The permittee shall be liable for any noncompliance ofthe permitted activity until the transfer is approved by the Department.

A revised permit shall be obtained before construction begins except as provided in Rule 62-620.300, F.A.C.

17. The permittee shall give advance notice to the Department ofany planned changes in the permitted facilityor activity which may result in noncompliance with permit requirements.

The permittee shall be responsible for any and all damages which may result from the changes and may be subject to enforcement action by'he Department for penalties or revocation ofthis permit. The notice shall include the followinginformation:

A description ofthe anticipated noncompliance; b.

The period ofthe anticipated noncompliance, including dates and times; and c.

18. Sampling and monitoring data shall be collected and analyzed in accordance with Rule 62-4.246, Chapters62-160 and 62-601, F.A.C., and 40 CFR 136, as appropriate.

Monitoring results shall be reported at the intervals specified elsewhere in this permit and shall be reported on a Discharge Monitoring Report (DMR), DEP Form 62-620.910(10).

b.

Ifthe permittee monitors any contaminant more frequently than required by the permit, using Department approved test procedures, the results ofthis monitoring shall be included in thc calculation and reporting ofthe data submitted in the DMR.

c.

Calculations for all limitations which require averaging ofmeasurements shall use an arithmetic mean unless otherwise specified in this permit.

d.

Any laboratory test required by this permit for domestic wastewater facilities shall be performed by a laboratory that has been certified by the Department ofHealth and Rehabilitative Services (DHRS) under Chapter 10D41, F.A.C., to perform the test. On-sitc tests for dissolved oxygen, pH, and total chlorine residual shall be performed by a 23

Bypass is prohibited, and the Department may take enforcement action against a permittee for bypass, unless the permittee affirmatively demonstrates that:

1.

Bypass was unavoidable to prevent loss oflife, personal injury, or severe property damage; and 2.

There were no feasible alternatives to the bypass, such as the use ofauxiliary treatment facilities, retention ofuntreated wastes, or maintenance during normal periods ofequipment downtime. This condition is not satisfied ifadequate back-up equipment should have been installed in the exercise ofreasonable engineering judgment to prevent a bypass which occurred during normal periods ofequipment downtime or preventive maintenance; and C

The permittee submitted notices as required under Permit Condition IX. 22. b. ofthis permit.

b.

Ifthe permittee knows in advance ofthe need for a bypass, it shall submit prior notice to the Department, ifpossible at least 10 days before the date ofthe bypass.

The permittee shall submit notice ofan unanticipated bypass within24 hours oflearning about the bypass as required in Permit Condition IX.'0. ofthis permit. A notice shall include a description ofthe bypass and its cause; the period ofthe bypass, including exact dates and times; ifthe bypass has not been corrected, the anticipated time it is expected to continue; and the steps taken or planned to reduce, eliminate, and prevent recurrence of the bypass.

c.

The Department shall approve an anticipated bypass, after considering its adverse effect, ifthe permittee demonstrates that it willmeet the three conditions listed in Permit Condition IX. 22. a. 1. through 3. ofthis permit.

d.

A permittee may allow any bypass to occur which does not cause reclaimed water or efIIuent limitations to be exceeded ifit is for essential maintenance to assure efficient operation.

These bypasses are not subject to the provisions ofPermit Condition IX.22.

23. Upset Provisions a.

A permittee who wishes to establish the affirmative defense ofupset shall demonstrate, through properly signed contemporaneous operating logs, or other relevant evidence that:

Public Comment Period The Department ofEnvironmental Protection proposes to issue a wastewater facilitypermit to this applicant subject to the aforementioned reclaimed water or effluent limitations and conditions. This decision is tentative and open to comment from the public.

Interested persons are invited to submit written comments regarding permit issuance on the draft permit limitations and conditions to the following address:

Allcomments received within 30 days followingthe date ofpublic notice, pursuant to Rule 62-620.550, F.A.C., willbe considered in the formulation ofthe final decision with regard to permit issuance.

Any interested person may submit written comments on the Department's proposed permitting decision or may submit a written request for a public meeting to the address specified above, in accordance with Rule 62-620.555, F.A.C. Thc comments or request for a public meeting must contain the information set forth below and must bc received in the above named District office ofthe Department within 30 days ofreceipt or publication ofthe public notice. Failure to submit comments or request a public meeting within this time period willconstitute a waiver ofany right such person may have to submit comments or request a public meeting under Rule 62-620.555, F.A.C.

The Department will respond to all significant comments in writing. The Department's response to significant comments willbe included in the administrative record ofthe permit and willbe available for public inspection at the above named District office ofthe Department.

Unless a request for an administrative hearing, or an extension oftime to file a petition for an administrative hearing, as indicated in d. below, is granted, the Department willtake final agency action by issuing the permit or denying the permit application. Ifan administrative hearing is convened, final agency action willbe based on the outcome ofthe hearing.

Administrative Hearin A person whose substantial interests are affected by the Department's proposed permitting decision has the opportunity to petition for an administrative proceeding (hearing) to challenge the Department's decision in accordance with Section 120.57, F.S.

An administrative hearing is an evidentiary proceeding in which evidence is presented by testimony and exhibits before an independent hearing officer. The result ofan administrative hearing is the issuance ofthe hearing officer's recommended order to the Department, including the hearing officers findings offact, based on the evidence presented at the hearing.
