Re: Turkey Point Units 3 and 4 Docket Nos. 50-250 and 50-25 I Proposed License Amendment Environmental Protection P lan In accordance with IO CFR 50.90, Florida Power 8c Light Company (FPL) requests that Appendix B of Facility Operating Licenses DPR-3I and DPR-4l be amended to delete the remaining Sections

!.0 and 5.0 of the Turkey Point Plant Environmental Technical Specifications (ETS),

and replace the ETS with the enclosed Enviromental Protection Plan.

It has been determined that the proposed amendments do not involve a significant hazards consideration pursuant to IO CFR 50.92.

A no significant hazards consideration evaluation is attached.

In accordance with IO CFR 50.9I(b), a copy of the proposed amendment is being forwarded to the State Designee for the State of Florida.

In accordance with IO CFR l70.I2(c), FPL Check No.

3984 for (I50.00 is at tached.

The proposed amendment has been reviewed by the Florida Power

& Light Company Nuclear Review Board and Environmental Review Group.

ATTACHMENT I SAFETY AND NO SIGNIFICANT HAZARDS CONSIDERATION EVALUATION Descri tion of Pro osed Chan es:

The proposed amendments would delete, the remaining sections, Sections I.O and 5.0, of the, Turkey Point Plant Environmental Technical Specifications (ETS) and replace the ETS with an Environmental Protection Plan.

Section I.O includes the definitions for terms used in the ETS.

Section 5.0 describes the administrative controls and procedures necessary to implement the ETS requirments.

Recently issued amendments have deleted the non-radiological and radiological environmental monitoring programs and requirements from the ETS.

Amendments 93/87, issued March I I, l983, deleted the non-radiological water quality related requirements.

Amendments I 00/94, issued January 4,

I 984, deleted the non-radiological monitoring programs related to terrestrial, biological, and physical monitoring. Amendments l05/99, issued August 24, l984, deleted the groundwater monitoring requirements and other environmental protection limits.

Environmental concerns which relate to water quality and biological monitoring will be regulated by the Environmental Protection Agency and other Federal, State and Local Environmental Agencies.

Also, Amendments I 03/97, issued April 23, I 984, deleted the radiological environmental monitoring requirements from the ETS.

These requirements are now included in the Turkey Point Plant Technical Specifications, Appendix A to Operating License Nos. DPR-3 I and DPR-4I.

The requirements of Sections I.O and 5.0 of the ETS which are still applicable will be included in the Turkey Point Plant Environmental Protection Plan, which would provide for the protection of the environment at the plant site and immediate adjacent areas.

Basis for No Significant Hazards Consideration Determination:

The Commission has provided standards for determining whether a significant hazards consideration exists (IO CFR 50.92(c)).

A proposed amendment to an operating license for the facility involves no significant hazards consideration if operation of the facility in accordance with the proposed amendment would not:

(I) involve a significant increase in the probability or consequences of an accident previously evaluated, or (2) create the possibility of a new or different kind of accident from any accident previously evaluated, or (3) involve a significant reduction in a margin of safety.

in accordance with the proposed amendments would not:

(I)

Involve a significant increase in the probability or consequence of an accident previously evaluated.

The proposed amendments are administrative in that they replace administrative requirements in Appendix B with similar requirements in an Environmental Protection Plan.

They do not change any current safety limitation related to operation of the plants.

(Safety limits are necessary to reasonably protect the integrity of certain physical barriers which guard against the uncontrolled release of radioactivity).

They do not modify any of the design features of the plant.

The radiological monitoring programs included in the Appendix A Technical Specifications are not affected by these amendments.

Create the possibility of a new or different kind of accident from any accident previously evaluated.

As stated

above, the proposed amendments do not affect the design or operation of the plant, and therefore could not cause a new or different kind of accident from any previously evaluated to occur.

(3)

Involve a significant reduction in a margin of safety.

The proposed amendments are not safety-related, pose no reduction in any requirement for safe operation of the plant and, therefore, could not affect any margin of safety.

As discussed

above, the radiological monitoring programs are not affected by these amendments.

Based on the above discussion, operation of Turkey Point Units 3

and 4 iin accordance with the proposed amendments

would, therefore, not involve a

significant hazards consideration.

Protection of the environment at the Turkey Point Plant and immediate adjacent areas will continue to be provided for by the Environmental Protection Plan which replaces the existing Appendix B Environmental Technical Specifications.
