Dear Mr. Harris:

The requirements as stated in the St. Lucie NPDES Permit,Section I.A. 11 and Section VIA require St. Lucie Plant to schedule a meeting with the FDEP within six months of completing the Uprate Projects for Unit 1 and Unit 2 to discuss schedule and implementation of a "aquatic organisms return plan."

The schedule in Section VI.4 assumed that the final CWA 316(b) rule would be in place to provide guidance for the development of said plan. Since the final rule has yet to be issued we request that our six month commitment to schedule a meeting with the FDEP as stated in Section VI.4 be changed to "within six months of the promulgation of the final 316(b) rule."
