Perry Nuclear Power Plant, Unit No. 1 Docket No. 50-440, License No. NPF-58 Withdrawal of Intent to Transition to NFPA 805 Perry Nuclear Power Plant P.O. Box97 10 Center Road Perry. Ohio 44081 440-280-5382 Fax: 440-280-8029 By letter to the Nuclear Regulatory Commission (NRC) dated December 22, 2005 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML060040259), FirstEnergy Nuclear Operating Company (FENOC) indicated the intent for a fleet-wide adoption of National Fire Protection Association Standard 805, "Performance - Based Standard for Fire Protection for Light Water Reactor Electric Generating Plants, 2001 Edition" (NFPA 805), in accordance with 10 CFR 50.48(c).. On March 31, 2009 (ADAMS Accession No. ML091030133), FENOC clarified the intent to adopt NFPA 805 at the Perry Nuclear Power Plant Unit 1 (PNPP) following implementation at the Beaver Valley Power Station Units 1 and 2 (BVPS) and the

. Davis-Besse Nuclear Power Station Unit 1 (DBNPS).

A robust design and effective fire protection program in accordance with 10 CFR 50.48(a) allows FENOC to continue to maintain fire safety at PNPP in accordance with the conditions specified in the Facility Operating License. Accordingly, transition to NFPA 805 is no longer planned for implementation at PNPP.
