Dear Sir:

! This application for an amendment to the James A. FitzPatrick Technical Specifications l proposes changes required to implement the BWR Owners' Group Long-Term Stability l Solution Option 1-D at the James A. FitzPatrick Nuclear Power Plant. These changes include provision of core power / flow operating map restrictions based on a plant and cycle specific thermal hydraulic stability exclusion region to prevent the occurrence of power oscillations, and those associated with the removal of the Simulated Thermal Power Monitor time delay l from the Average Power Range Monitor flow-biased scram to provide protection from l postulated power oscillations. ,

l The NRC has previously approved similar Technical Specification changes for the Vermont j i Yankee Nuclear Power Station as the lead plant for the Option I-D stability solution (Reference 1).

Editorial changes which support revised specifications, improve Bases readability, and enhance the presentation of requirements for single-loop operation, are also proposed.

The Authority committed to submit this amendment application in its submittal of the Plant Specific Licensing Topical Report for Long-Term Solution on Reactor Stability (Reference 2).

The signed original of the Application for Amendment to the Operating License is enclosed for filing. Attachment I contains the proposed new Technical Specification pages, and Attachment 11 is the Safety Evaluation for the proposed changes. A markup of the affected Technical Specification pages is included as Attachment lll.

There are no new commitments contained in this submittal. j i

A copy of this application and the associated attachments are being provided to the designated New York State official in accordance with 10 CFR 50.91.
