Dear Sir or Madam:

On March 12, 2012, the Nuclear Regulatory Commission (NRC) issued an order (Reference 1) to the James A. FitzPatrick Nuclear Power Plant (JAF). The Order was immediately effective and directs JAF to have a reliable hardened vent (RHV) to remove decay heat and maintain control of containment pressure within acceptable limits following events that result in the loss of active containment heat removal capability or prolonged station blackout (SBO). Specific requirements are outlined in Attachment 2 of the Order.

The Order requires submission of an initial status report 60 days following issuance of the final interim staff guidance (ISG). The finallSG (Reference 2) was issued August 29, 2012. The purpose of this letter is to provide the initial status report pursuant to Section IV, Condition C.2, of the Order (Reference 1) within 60 days following issuance of the ISG (Reference 2). This report confirms JAF has received the ISG and is in the process of evaluating the guidance for the purpose of having a reliable hardened vent (RHV) to remove decay heat and maintain control of containment pressure within acceptable limits following events that result in the loss of active containment heat removal capability or prolonged station blackout (SBO) as described in of the Order.

JAFP-12-0123 Page 2 of 3 The ISG, Section 4.0 contains the specific reporting requirements for the initial status report. The following information provides the status pursuant to Section 4.0 of the ISG.

Major activities completed during the previous reporting period:

Resources have been identified and project plans initiated, including development of milestones, to assure compliance with the Order.

Planned activities for the next six months:

Development and submittal of the overall integrated plan.

Completion of conceptual design.

Technical difficulties encountered that could affect the ability to provide the licensee's February 28, 2013, submittal:

None at this time.

Project milestones schedule through completion of installation and testing:

A project milestones schedule will be provided with the overall integrated plan.

Implementation of the Order will be completed for JAF prior to startup from Refueling Outage (RFO) 22 (Fall 2016).

This letter contains no new regulatory commitments.
