NRC INSPECTION REPORT 072-01 1/10-02

Dear Mr. Ronningen:

On March 16-17, 2010,the U.S. Nuclear Regulatory Commission (NRC) conducted a special inspection at the Sacramento Municipal Utility Districts Rancho Seco facility and the Rancho Seco Independent Spent Fuel Storage Installation (ISFSI). The purpose of this inspection was to evaluate whether the protection of the ISFSI was in compliance with the Physical Protection Plan (PPP) for the ISFSI, and the additional security measure (ASM) imposed by the NRC order dated September 17, 2007.

At the end of the site visit on March 17, 2010, the inspectors briefed you and other members of your staff on the scope of the findings; however a final exit briefing was not conducted at this time due to an outstanding request for additional information. On June 9, 201 0, a final telephonic exit was conducted with you. The enclosed inspection report presents the results and scope of the inspection.

Based on the results of this inspection, the NRC identified two Severity Level IV violations of NRC requirements. These identified violations were determined to be of low safety significance and circumstances surrounding the violations are discussed in the enclosed report.

Furthermore, because of the low safety significance and because they were entered into your corrective action program, the NRC is treating these violations as Non-Cited Violations (NCV),

consistent with Section VI.A.l of the Enforcement Policy. If you contest these violations or the severity level of the NCVs, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the U. S. Nuclear Regulatory Commissiori, ATTN: Document Control Desk, Washington, DC 20555-0001, with a copy to the Regional Commission, Washington, DC 20555-0001.
