During an NRC inspection conducted on November 25,1997 and December 8,1997, a violation of NRC requirements was identified, in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," (Enforcement Policy), NUREG 1600, the violation is listed below:

10 CFR 20.1801 requires that the licensee secure from unauthorized remuval or access licensed materials that are stored in controlled or unrestricted areas.10 CFR 20.1802 requires that the licenses control and maintain constant surveillance of licensed matrial that is in a controlled or unrestricted area and that is not in storage. As defined in 10 CFR 20.1003, controlled area means an area outside of a restricted area but inside the site boundary, access to which can be limited by the licensee for any reason; and unrestricted area means an area, access to which is neither limited nor controlled by the licensee.

Contrary to the above, on December 8,1997, the licensee did not secure from unauthorized removal or access a-radiography exposure device containing approximately 74 curies of Iridium 192 in's sealed source, nor did the licensee radiographers control and maintain constant surveillance of ths licensed material.

Specifically, the exposure device was located in a darkroom at the back of a truck in an unrestricted area at e temporary jobsite in Newark, Delaware, and at the time, although the door to the truck's darkroom was locked, the front door to the truck was unlocked with the keys in the ignition, and there were keys or the key ring that would open the truck's darkroom, as well as the overpack securing the radiography device.
