Appendix NOTICE OF V10LA110N Consumers Power Company Docket No. 50-255 As a result of the inspection conducted on September 9 through November 18, 1985, and in accordance with the General Policy and Procedures for NRC Enforcement Actions (10 CFR Part 2, Appendix C), the following violations were identified: As required by 10 CFR 50.49 and as stated in Consumers Power Company's letter dated November 30, 1984, eight thermostats related to the Safeguards Equipment room air coolers were to have qualified replacements installed by March 31, 198 Contrary to the above, the licensee determined on September 9,1985, that the planned modification work to install qualified replacement thermostats had not been cJmplete This is a Severity Level IV violation (Supplement I). CFR 50 Appendix B Criterion XVI states in part: " Measures shall be established to assure that conditions adverse to quality, such as failures, malfunctions, deficiencies, deviations, defective material and equipment, and nonconformances are promptly identified and corrected." Nuclear Operations Department QA Standard Q01 " Corrective Action and Control of Nonconforming Items" requires that an Event Report be initiated for potential violations of the Technical Specifications (Section 5.3.1), that the Event Rep *t be reviewed by the Corrective Action Review Board (CARB).within one e rking day (Section 5.4.2),

and a determination made if immediata J.orrective action is require Technical Specification 4.17.2 requires monthly verification of valve position and annual stroking of each tes*:ble valve in the flowpath for the fire suppression water system. dministrative Procedure 9.23

" Technical Specification Surveillanc. ..ccedure Implementation and Corrective Action" requires that actioa 'oe taken to complete a missed test as soon as possible (Section v.7).

Contrary to the above, an audit c. fire protection conducted September 30 through October 4, 1985, resulted in a finding that a fire suppression water system valve was not being checked as required by Technical Specification 4.17.2. Action was not taken to test the valve until the evening of November 1, 198 ~

CFR 50.54 (m)(2)(iii) states: "When a nuclear power unit is in an operational mode other than cold shutdown or refueling, as defined by the unit's technical specifications, each licensee shall have a person holding a senior operator license for the nuclear power unit in the control room at all times. each fueled nuclear power unit, a licensed operator or senior operator shall be present at the controls at all times."

Contra y to the above, on October 9, 1985, at about 1610 hours0.0186 days <br />0.447 hours <br />0.00266 weeks <br />6.12605e-4 months <br /> no licensed Senior Reactor Operator was present in the Control Room for about a five minute period.
