NOTICE OF VIOLATION Oak Hill Hospital License No. 24-16612-01 As a result of the inspection conducted on January 21, 1986, and in accordance with the " General Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the following violations were identified:

1.

License Condition 15 requires that all licensed material be possessed and used in accordance with statements, representations, and procedures contained in application dated June 20, 1980.

Application dated June 20, 1980, states that calibration of the dose calibrator shall be as described in Appendix D.

Appendix D states that the linearity check shall include a comparison between the measured value and the calculated value of the technctium-99m used to perform the test.

Contrary to this requirement, linearity checks did not always include a comparison between the measured value and the calculated value of the technetium-99m'used to perform the test.

As an example, the linearity checks performed on July 17 and October 29, 1985, did not include the comparison.

This is a Severity Level IV violation (Supplement VI).

10 CFR 20.207(a) requires that licensed materials stored in an unrestricted area shall be secured against unauthorized removal.

10 CFR 20.207(b)

requires that materials not in storage be under constant surveillance and immediate control of the licensee.

Contrary to this~ requirement, on January 21, 1986, millicurie quantities of technetium-99m and other licensed material was not secured from unauthorized removal and was not under the licensee's constant surveillance and immediate control.

The " hot" laboratory door was open, allowing access to visitors, employees, and patients.

Licensed material was not under constant surveillance and immediate control of the technolo~ gist.

This is a Severity Level IV violation (Supplement IV).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
