NOTICE OF VIOLATION Northwest X-Ray, Inc.
License 99990004/85-07 Idaho Falls, Idaho NRC General License EA 85-138 l
From June 27 - October 8, 1985 the NRC's Office of Investigations (OI) conducted an investigation to determine whether the President of Northwest X-Ray, Inc.
intentionally violated the terms of an NRC license condition by using radiographers l
not listed in the license and not authorized by the NRC. This investigation resulted in an 01 Report dated October 8, 1985 which documents that the President

of Northwest X-Ray, Inc. willfully violated the provisions of 10 CFR 150.20 by using qualified radiographers not listed on the Idaho license and not authorized by the NRC.
In accordance with the " General Statement of Policy and Procedure for NRC Enforce-nent Actions," 10 CFR Part 2, Appendix C (1985), the violation is listed below:

10 CFR 150.20 provides in part that any person holding a specific license from an agreement state is granted a general license to conduct the same activity in non-agreement states subject to the provisions of Part 20 and Subpart B of Part 34 of this chapter. Persons engaging in activities in non-agreement states under a general license shall comply with all terms and conditions of the specific license issued by the agreement state.
The agreement state license held by Northwest X-Ray, State of Idaho License IDA-207 Condition ll, specifies by name the only persons authorized to act as radiographers or radiographer's assistants.

Contrary to the above, from May 21 to June 14, 1985, radiographers not

listed on the Idaho license and not authorized by the NRC to perform radiography conducted radiography near Cutbank, Montana.

This is a Severity Level III violation (Supplement VII).

within 30 days of the date of this Notice and include:
(1) the reason for the

violations, and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending your response time.
