Appendix NOTICE OF VIOLATION i
United States Steel Corporation License No. 12-13386-02

As a result of the inspection conducted on June 17 through July 11, 1985, and in accordance with the General Policy and Procedures for NRC Enforcement Actions, (10 CFR Part 2, Appendix C), the following violations were identified:

1.
License Condition No. 16 requires that licensed material be possessed and used in accordance with the statements, representations, and procedures contained in application dated April 27, 1981.
Item 15 of the referenced application requires the radiation safety officer. to perform quarterly physical inventories.
Contrary to the above, quarterly physical inventories have not been performed.
Specifically, the last inventory was performed in 1983.
This is a Severity IV violation (Supplement VI).

10 CFR 20.207(b) states that licensed materials in an unrestricted area l
and not in storage shall be tended under the constant surveillance and j
immediate control of the licensee.
Contrary to the above, licensed materials in an unrestricted area were not under the constant surveillance and immediate control of the licensee. Specifically, two cesium-137 gauges and one americum-241 gauge l
were unaccounted for in an unrestricted area of the licensee's facility for l
at least one year.
This is a Severity Level IV violation (Supplenent IV).
