ENCLOSURE-NOTICE OF VIOLATION Green Mountain Company Docket No. 030-28670 Charleston, WV License No.
47-23082-01 During the Nuclear Regulatory Commission (NRC) inspection conducted on July 23, 1986, violations of NRC requirements were identified. The violations involved the frequency for leak testing the licensed gauge and the availability of personnel monitoring records.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the violations are listed below:
A.
License Condition 14.A(3) requires the licensee to test each sealed source for leakage prior to use if the source has been stored and not -tested for leakage within six months prior to the date of use.
Contrary to the above, the licensee did not test the sealed sources in their Troxler Model 3411B moisture-density gauge prior to use in June and July, 1986, at a Clarksburg, West Virginia, site. The last leak test performed was on October 31, 1985.
This is a Severity Level IV violation (Supplement VI).
B.
10 CFR 20.401(a) requires a licensee to maintain records showing the radiation exposures of all individuals for whom personnel monitoring is required under 10 CFR 20.202.
Contrary to the above, the licensee had not maintained the required records.
No records were available from the date the device containing the licensed material was received, June 10, 1985, until the date of the inspection, July 23, 1986.
This is a Severity Level V violation (Supplement IV).
Pursuant to the provisions of 10 CFR 2.201, Green Mountain Company is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including (for each violation): (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and
