ENCLOSURE NOTICE OF VIOLATION
.
U. S. Department of Transportation Docket No. 030-06627 Arlington, VA License No. 45-13691-01 During the Nuclear Regulatory Commission (NRC) inspection conducted on June 19, 1986, violations of NRC requirements were identified. The violations involved the use of licensed material by an unqualified person, failure to perform leak tests, failure to use shipping papers and a failure to post Form NRC-3.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the violations are listed below:
A.
License Condition 12 requires that licensed material shall be used by, or under the supervision and in the physical presence of any individual who has completed the Troxler or Campbell Pacific Nuclear training course or has completed the training described in the licensee letter received April 24, 1986. The licensee shall maintain records of the individuals designated as authorized users.
Contrary to the above, an individual working independently in the field has not completed any of the above required training. Use periods are between June 8, 1984 and September 7, 1984, between June 1, 1985 and August 28, 1985 and between March 21, 1986 and June 19, 1986.
This is a Severity Level IV violation (Supplement VI)
B.
License Condition 15 requires the licensee to test each sealed source l
containing byproduct material for leakage or contamination at intervals not to exceed six months.
Contrary to the above, sources were not leak tested as required.
At Sevierville, Tennessee, Source No. 1702 was not leak tested between January 11, 1983 and January 9, 1984, and between January 9, 1984 and February 21, 1985.
Source No. 1796 was not leak tested between June 28, 1983 and July 19, 1984, and between July 19, 1934 ard March 11, 1985.
Source No. 2224 was not leak tested between June 7,1983 and July 25, 1984.
In addition, six sealed sources at the Arlington, Virginia, facility were not leak tested between September 12, 1983 and September 20, 1984.
This is a Severity Level IV violation (Supplement VI)
10 CFR 71.5(a) requires that each licensee who transports licensed material c.
shall comply with the applicable requirements of the regulations, appropriate to the mode of transport, of the Department of Transportation in 49 CFR, parts 170 through 189.

Jul.141986 49 CFR 172.200(a) requires that each person who offers a hazardous material for transportation shall describe the hazardous material on a shipping paper.
Contrary to the above, shipping papers have not been available during transport by the licensee since the start of licensed activities.
This is a Severity Level V violation (Supplement VI)

10 CFR 19.11 requires a licensee to post Form NRC-3, " Notice to Employees,"
to permit individuals who work in or frequent any portion of a restricted area to observe the form on their way to or from the restricted area, f
Contrary to the above, on June 19, 1986, the licensee had not posted Form NRC-3 as prescribed in or near a restricted area at the Sevierville facility.
This is a Severity Level V violation (Supplement VI).
Pursuant to the provisions of 10 CFR 2.201, Severity Level IV and Supplement VI is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
