SUBJECT:

D. C. COOK NUCLEAR POWER PLANT, UNITS 1 AND 2 NRC SAFEGUARDS INSPECTION OF COMPLIANCE WITH ORDER INSPECTION REPORT 50-315/03-03; 50-316/03-03(DRS)

Dear Mr. Bakken:

On January 16, 2003, the NRC completed an inspection at your D.C. Cook Nuclear Power Plant, Units 1 and 2. The enclosed inspection report documents the inspection findings which were discussed on January 16, 2002, with Mr. J. Pollock and other members of your staff.

The inspection examined activities conducted under your license as they relate to safety and compliance with an Order issued on February 25, 2002, which required your site to implement specific measures related to the security of your facility. The inspection utilized Temporary Instruction 2515/148, Inspection of Nuclear Reactor Safeguards Interim Compensatory Measures, to verify implementation of the Order as clarified in your response dated March 15, 2002. Within these areas, the inspection consisted of selected examination of procedures and representative records, observation of activities, and interviews with personnel.

Based on the results of this inspection, no findings of significance were identified. The inspectors identified an unresolved item regarding access to certain contingency equipment by armed responders. This item remains open pending review by the Office of Nuclear Security and Incident Response.

The material enclosed herewith contains Safeguards Information as defined by 10 CFR 73.21 and its disclosure to unauthorized individuals is prohibited by Section 147 of the Atomic Energy Act of 1954, as amended. Therefore, the material will not be placed in the Public Document Room.

In accordance with 10 CFR 2.790 of the NRCs Rules of Practice, a copy of this letter, without enclosure will be made available electronically for public inspection in the NRCs Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams/html (the Public Electronic Reading Room).
