Thank you for your letter of December 7,1979 in response to our letter and Notice of Violation dated November 7,1979.

We have reviewed your response which indicates that you do not interpret Technical Specification J.2 as requiring a review by the Nuclear Reactor Committee of changes to your facility prior to their implementation. Please let me advise you of the following. We regard Technical Specification J.2 as being only a list of the responsitsilities of the Nuclear Reactor Comittee. The Comittee must in all conscientiousness act in a timely manner to discharge each of the listed responsibilities.

Technical Specification J.2 assigns the Committee the responsibility for compliance with paragraph 50.59 of 10 CFR 50, and Technical Specification J.2.d lists additional items the Committee must consider in their review of facility changes.

A post implementation review by the Committee of facil_ity changes can not meet the requirements of 10 CFR 50; furthermore, could conceivably allow the operation of the facility in an unsafe manner.

In addition, an adequate review by the Committee should have led to an orderly and safe design change implementation by identifying the lack of an approved calibration procedure, of documentation of instrument calibration and of a startup test procedure.

Our position continues to be that your actions cited in the Notice of Violation constitutes an item of noncompliance.

You must, therefore, comply with 10 CFR 2.201 which requires you to submit to this office, within 20 days of your receipt of this letter, a written statement of explanation in reply, including:

(1) corrective steps which have been or will be taken by you, and the results achieved; (2)

corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
