RESPONSE TO NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 50-73/98-201; 50 70/98-201; 50 183/98-201)

Dear Mr. Stimmell:

Thank you for your response of April 17,1998, to our Notice of Violation issued on March 18,1998, concerning activities conducted at your Nuclear Test Reactor (NTR)

facility.

Regarding the first example of Violation 2, you stated in your response that you disputed i

the violation because Technical Specification 4.6.1, which provides a definition of

" monthly," does not apply to radiation surveys specified in your Nuclear Safety Proceduro

NSP 3550. You also stated that there is no time interval spec.fied in the NTR Technical Specifications for Radiation Surveys. You indicated further that, despite the lack of a documented requirement for a time period definition, Nuclear Safety Procedure NSP 3550 will be changed to include time interval requirements and operational considerations. After reviewing your response, the staff has concluded that the definition in the technical specification does not apply to the specific procedure and that the issue of a specified time i

interval has been resolved by your corrective actions. Therefore, the first example of

Violation 2 has been withdrawn.

We have evaluated your response to the other violations and found that they meet the requirements of 10 CFR 2.201. We will examine the implementation of your corrective action during future inspections.
