10CFR71.5(a) requires, inpart, that eachlicensee whotransports licensed materials outside the site ofusage orwhere transport ison public highways, shallcomply with theapplicable requirements ofthe Department of Transportation Regulations in49CFRParts 171through 180.49CFR172.602(b) requires, inpart thatemergency response information required by49CFR172.602(a) mustbe available ona shipping paper, orina document, otherthan a shipping paper, and(c) maintained inthesamemanner asprescribed for shipping paper Contrary tothe above, onAugust 5,2021, PennTesting, Inc., transported licensed materials onpublic highways anddidnotmaintain emergency response information required by49CFR172.602(a) inits source transport vehicle locatedat a temporary job sites in Bridgeville,Delawar Specifically, thelicensee's "Radiation Safety Survey form andShipping Document"and their "Operating and Emergency Procedures" wereimmediately available tothedriver butdidnotfully include information thatcanbe used inthemitigation o anincident including information regarding: (1) Immediate hazards tohealth; (2) Risks offire orexplosion: (3)immediate precautions to betaken intheevent ofanaccident orincident; (4)immediate methods for handling fires: (5) Initialmethods forhandling spillsorleaks it theabsence offire;and(6) preliminary first aid measure This isa Severity Level IVviolation (Enforcement Policy Section 6.8).
