requires, inpart, that eachlicensee whotransports licensed materials outside thesite ofusageorwheretransport ison public highways, shall comply withtheapplicable requirements oftheU.S.Department of Transportation Regulations in49CFRParts 171through 180.49CFR172.602(b)

requires, inpartthat emergency response information required by49CFR172.602(a)

mustbe available onashipping paper, orinadocument, other thanashipping paper, and(c)

maintained inthesamemannerasprescribed for shipping papers.

Contrary totheabove,onAugust 5,2021,PennTesting, Inc.,

transported licensed materials onpublic highways anddidnotmaintain emergency response information required by49CFR172.602(a)

initssource transport vehicle locatedat a temporary jobsites in Bridgeville, Delaware.

Specifically, thelicensee's

"Radiation Safety Survey formandShipping Document"and their "Operating and Emergency Procedures" wereimmediately available tothedriver butdidnotfully include information that canbe used inthemitigation o

anincident including information regarding:

Immediate hazards tohealth; (2)

Risks offire orexplosion:

immediate precautions to betaken intheeventofanaccident orincident; (4)

immediate methods forhandling fires:

(5)

Initial methods for handling spillsorleaks it theabsenceoffire; and(6)
