This refers to the routine, unannounced inspection conducted by:

Mr. Richard A. Leonardi, Jr., of this office on' November 17, 1993, of

activities conducted by Brosz Engineering,-Inc., at; locations within the State i
of South Dakota, an area under NRC' jurisdiction. Activities reviewed during the inspection were conducted under the provisions'of 10 CFR 150.20 and the,
.
~
l conditions of Byproduct Material License 33-25603-01 issued by.the state of i
North Dakota. At the conclusion of the inspection, the findings were discussed with Mr. Blake D. Barringer, Vice President, and sole user of the.
'
nuclear gauge in South Dakota.
'
The inspection was an examination of the activities as they relate to:
.

i radiation safety and to compliance with the Commission's. rules' and regulations;
I and the conditions of the license. The inspection was limited (to a review of'
!
records associated with activities conducted in South Dakota from June'25'.
.
through November 17, 1993.
No violations or deviations were identified; therefore,.no response to this
'
letter is required.
t The inspector noted that the licensee had maintained a single nucle'ar gauge at.
'
a temporary jobsite in South Dakota since June 25,.1993.. Based upon a review:
I of detailed utilization records maintained.by the licensee, the inspector -
!
determined that the licensee had properly modified the. original NRC Form 241
!
L submitted to the NRC Region IV office to reflect the use'of licensed materials
'
in several locations under NRC jurisdiction.
In addition,; thel. inspector; determined that the licensee had complied with applicable transportationa requirements while transporting nuclear gauges to and from. temporary jobsites.
The inspector also discussed with members of your staff certain provisions of
the revised 10 CFR Part 20 which becomes effective on January 1,:1994.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a. copy of -

this letter will be placed in the NRC Public Document Room.
