As'a part of the inspection conducted by the State of Nevada during-l' October 25-29, 1982 at the'Beatty Burial Site, one shipment from Combustion Engineering Company, Hematite, Missouri was inspected. The results of the inspection which were received by the Region V office by L - telephone on November 2, 1982 are detailed in this report.
. Results: One violation of D0T/NRC regulations was identified.
It appears that the NRC Region III office and the Department of Transportation are the appropriate organizations to take enforcement action.

Background ,
As a part of the low level waste inspections conducted by the State of ' , -Nevada inspector during the period of.0ctober 25-29,'1982 at the Beatty, ' Nevada burial site, a-shipment of waste received from Combustion Engineering ' , ' Company, Hematite, Missouri.was inspected on October 26,1982.
As a result of this inspection one box was observed to have a hole in the ' s i de'. , f Pursuant to this violation of D0T/NRC regulations ~, the State of Nevada has imposed a $1,500.00 penalty'and a six month suspension.of the burial pennit.

'(a) The shipment consisted of 30, 55 gallon drums, 20, 83 gallon L , drums and 14 boxes containing low-level LSA' quantities of SNM and byproduct materials.
(b) Box No. T-112 was observed to have a hole, approximately 1/32 of an inch in diameter located in the side of the box approximately ,
. five inches from the bottom and five inches in from the corner ~of ' the box.
- (c) Radiation surveys of the box indicated no. loose radioactive
, contamination present.
' - (d) The state inspector has determined that the hole in the box ' ' constitutes a violation of 49 CFR 173.392(c)(1) which requires ' , that materials be packaged in strong, tight packages ~so that-i there will be no leakage of radioactive material under con'ditions . , normally incident to transportation.
