Purpose:
To provide the Connission the annual sumary of examinatice, licensing and requalification activities for Reactor
! Operators and Senior Reactor Operators. The last sumary was provided by 6ECY 86-13.
I Discussion: The enclosed graphs and tables report national operator licensing results for FY 1985 and FY 1986 and regional requalification program evaluation results for FY 1985 ant l FY 1986. i Candidate perforh.ince during FY 1986 did not differ significantly froa FY 1985. Examination results, broken down by license type and examination component, for FY 1915 and FY 1986 are presented in Enclosure 1. 1 FY 1986 examinatien results for each region are presented in Enclosure 2. Generally, the pass rates of all regions we'e consistent. The largest deviation was the pass rate on t*e Senior Reactor Operator simulator examination, which ranged from 75% to 921. However, evaluation of specific data areng the five regions indicates no consistent trend for any individual regipn for any aspect of the examination process or trends between FY 1985 and FY 1986. We will continue to evaluate examination results for trends and inconsistencier among regions as part of our oversight function. During FY 1986, requalification programs at seventeen facilities wereievaluated in accordance with HUREG-1021, Operator Licensing Examiner Standards. 1 taken by the facility licensees after our evaluations, one l unsatisfactory program was upgraded and is no longer l considered unsatisfactory. The other four unsatisfactory i and the three marginal programs are being upgraded and will be reevaluated during FY 1987. A graphical representation of FY 1985 and FY 1986 requalification p eg-am evaluations performed in accordance with NUREG-1021 is presented in ; Enclosure 3. FY 1986 facility program results, by region, ! are presented in inclosure 4. More detailed data on l operator licensing activities are provided in Enclosures 5 and 6. i All five regions aref participating in a pilot test of an 1 alternative program to NRC administered reTJalification ' l examinations (SECY86-333). Five facilities have been evaluated under this program. During Fiscal Year 1986, seventeen facilities were evaluated in accordance with NUREG-1021, Operator Licensing Examiner Standards. In addition, a pilot program on requalification examinations (SECY 86-333) at five facilities was conducted to test the feasibility of evaluating requalification prograns by reviewing and auditing facility administered written and operating examinations. Based upon insufficient information from the initial pi%t j program, the program is being continued for six months. i The Examiner Standards require the administration of HRC prepared writ.an and operating examinations to 20% of licensed operators and senior operaters. [ For these seventeen facilities detemin9tions of Satisfactory, Marginal or 1 Unsatisfactory were made in accordance with the Examiner Standards. The results for the seventeen programs evaluated in accordance with NUREG-1021 and the five programs evaluated in.accordance with the pilot program were fourteen satisfactory, three marginal, and five unsatisfactory prograns. Dircks l From: Executive Director for Operatims Sub jec t: RESULTS OF OPEPATCR LICENSING EXA.MINATIONS FOR SECOND }- QUARTER FY 1983 { Pu rpose_: To infom the Ccenissioners of examination and licensing 'I activities for 94 actor Operators and Senior Reactor Operators for January 1,1983 through March 31,1983. ; Discussion: The enclosed table reports' licensing action results, including issuances, denials or withdrawals and pass / fail rate for each , NRC licensing examination component. The total number of licensing actions processed in the second quarter FY 1983 was approximately the seme as for the first quarter FY 1983, (SECY 83-72A). The pass / fail rate renained consistent during the period. Most of the failures c:ntinue to occur on the written portion of the examination. As a result of the rcgionalization effort, we expect the examination processing time to be reduced and the data input into the Cperator Licensing Tracking Systen to be maintained on a current basis. Therefore, we plan to include in the next report, the results by region frce the third and fourth quarters of FY 1983. From the data available, it does not appear that candidate performance during FY 1985 differed significantly 'rce FY 1984 Exacination results, broken down by licecse type and examination c:mponent, for FY 1984 and FY 1985 are presented in Enclosure 1. FY 1985 examir.ation results for each Region are presented in Enclosure 2. Generally, the pass rates of all Reciens were consistent. The largest deviation was the pass rate on the Reactor Opera:cr written examination, which rangee frem 70% to 90%. ATTENTION: Freedom of Information Act Administrative Appeal
Dear Mr. Chilk:
This letter is a formal administrative appeal to the Nuclear Regulatory Commission's (NRC) response to Public Citizen's Freedom cf Information Act (FOIA) request FOIA-87-838. Copies of our initial request and all subsequent correspondence with the NRC are attached for your information. The NRC's Division of Rules and Records received the request on December 16, 1987. The request (see enclosed copy) asked for records which provided information "on the scores received by reactor operators and senior reactor operators on license qualification and requalification exams at each and every commercial nuclear generating facility." The request went on to state, "This does not include information on any individual operator, but it does include plant-specific statistics on the results of the exame,." Public Citizen received a single and final response from the NRC dated January 14, 1988 (enclosed). The response stated that documents had been placed in the NRC's Public Cccument Room that provide the examination results of Reactor Operators and Senior Reactor Operators for all of the years that we had requested except 1983, for which there were no data available. The response went on to state that "there are no data on requalification [examc) by plant as requested." However, no general requalification exam data was presented, and the response was marked "Fina1." In a telephone conversation on February 4, 1988 with Connie Pappas and Linda Robinson of the Freedom of Information and Privacy Acts Branch staf f, we were told that the Operator Licensing Branch does not compile information on requalification scores. Soon'thereafter, we became aware of an article in Tne Pittsburch Press [endlosed)whichstronglyimpliedthat the NRC did in fact compile information on requalification exam scores. r Assuming tha. the Freedom of Information and Privacy Acts (or Operator Licensin?' of fice. had simply made an unf:rtunate oversight, we contacted Connie ?appas, who had originally hand:ed the request. She suggested that we send a letter and a copy of the article to Linda Robinson, the Branrh Chief, who would then review the material. We sent such a letter on Tetruary 18 (enclosed) with a ec;) of the article . Subsequently, en two separate occasions (Fotruary 26 and 29), we telephoned the Freedom of Information and Privacy Arts Branch to see about the status :f our request. Both times the response was that they had not yet been able to locate the source of the information mentioned in the article, a'.though they would continue to try . In fact, Linda Robinson restated during the second call, in spite Of the new evidence, that the NRC has ne compilation of requalificatio exam scores. Over a week later, while inspecting the NRC's recent response to a separate FOIA regaest, Public Citizen discovered SECY-87-121, a memorandum from Victor Stello for "The Commissioners." and dated May 11, 1987. Its subjec- is "The 2-Year Evaluation on Inplementation of the Commission Policy Statement on Training and Qualification." Among the data that it provides is a short compilation of pass / fail rates for senior reactor operators and reactor operators on written and oral - requalification exams on an industry-wide basis (enclosed). Again, this information implies, indeed proves, that requalification exam scores are cor: piled by the NRC. That this later information was not included in the NRC's response to the original FC:A request is entirely I inexcusable. ; On March 11, we informed Linda Robinson of the existence of this new , piece of evidence. She said that she would try t: find out who wrote SECY-87-121 and would learn more about it that way. She also told us that the matter cf the newspaper article had stil'. not been resolved -- three weeks af ter it had been brought to her attention. On Match 22. Connie Pappas told us that Lindt Robinson and Donnia Grimsley, Directer of the Division of Rules and Fecords, had met with l their staff and that Mr. Grimsley would soon be citing us to give an i update on the status of our FOIA request. j On March 23, having heard nothing from Donnie Grimsley or Linda Robinson, Public Citizen contacted Ted Szymanski, a Section Leader in the Operator Licensing BranP. Mr. Szymanski told us that there were a number of SECY papers that regularly came out of the Executive Director of Operation's office which reported qualificatico and requalification exam scores on a plant-specific basis. Janet Lart.ing, of the same office, called back to list eleven such papers, giving information dating back to the beginning of 1983, as our original FCIA request stipulated. { We have since obtained a copy of one of these papers, SECY-86-13 (cover enclosed). We also request that the NRC investigate this matter and explain at what point the Freedom of Information Act was brushed aside, and why.
