Dear Mr. Smith:

This is in regard to your letter dated August 1, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), that the meeting minutes, notes, transcript, and handouts from a July 24, 198c CRGR meeting regarding IST/ISI Pump and Valve Programs be placed in the NRL Jublic Document Room.

By letter dated September 19, 1985, we informed you that the documents listed on enclosed Appendix A were available in the NRC Public Document Room (PDR) in the CRGR Review Group file under Accession No. 8508260104, and that the documents listed on enclosed Appendix B were being placed in that same PDR file.

After further review, the staff has determined that document 3 on enclosed Appendix B contains predecisional analyses, opinions, and recommendations of the NRC staff concerning subjects pending further consideration and decision and is exempt from mandatory disclosure pursuant to Exemption (5) of the F0IA, 5 U.S.C. 552(b)(5), and the Commission's regulations, 10 CFR 9.5(a)(5).

Release of this predecisional document would tend to inhibit the open and frank exchange of ideas essential to the deliberative process, and it is being withheld in its entirety.

4 Pursuant to 10 CFR 9.9 of the Comission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public lnterest. The persons responsible for the denial of the information are the undersigned and Mr. Victor Stello, Chairman, Comittee to Review Generic Requirements.

This denial may be appealed to the NRC's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."
