Dear Mr. Cunningham:
This is in response to your letter dated October 4,1978 in which you requested, pursuant to the Freedom of Information Act, the following:
- 1. A list of offerors whose proposals, submitted in response to NRC RFP-0SD-78-013, were deemed acceptable:
- 2. A copy of the top three proposals as found by the Source Selection Board.
Your letter was received by the Office of Administration on October 11, 1978.
In an October 19, 1978 letter to you from Mr. Kellogg V. Morton of NRC's Division of Contracts, you were furnished the number of prospective con-tractors solicited, the number of proposals received and award data for -
the successful offeror. You were also informed of the names of the offerors whose proposals were determined to be in the competitive range which are listed as follows:
Indiana Universi ty Nuclear Assurance Corporation Research Triangle Institute The BDM Corporation The enclosed documents or portions thereof, listed on Appendix A, are the released portions of the proposals submitted by the offerors. The documents, or portions thereof, listed in Appendix B, are considered confidential business (proprietary) information by the Indiana University, Nuclear Assurance Corporation, Research Triangle Institute, and the BDM Corporation and are being withheld from public disclosure pursuant to exemption (4) of the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5 (a)(4) of the Commission's regulations.
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld L exempt from production or 781127octsi

disclotere, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Edward L. Halman, Director, Division of Contracts.
This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, D.C. 20555, and should clearly state on thc envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
