May 8, 2014 EN-14-017 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Individual: Former Senior Reactor Operator, Grand Gulf Nuclear Station IA-13-059

Subject:

ISSUANCE OF PROHIBITION ORDER This is to inform the Commission that a Prohibition Order will be issued to a former senior reactor operator (SRO) on or about May 13, 2014. The Prohibition Order will prohibit the individual from engaging in NRC-licensed activities for a period of five years from the date of this Order. Furthermore, this Order requires the former SRO to notify the NRC of his involvement in NRC-licensed activities for a period of one year following the prohibition period.

After self-reporting an arrest, as required by 10 CFR 73.56, for driving under the influence of alcohol, the SRO was subjected to an increased fitness-for-duty (FFD) testing frequency in accordance with Grand Gulf Nuclear Station (Grand Gulf) procedures. On July 18, 2013, the individual participated in a FFD test, which resulted in a negative indication for alcohol, but a positive test result for a cocaine metabolite. Grand Gulf immediately relieved the SRO of his watchstanding duties and revoked his unescorted site access, in accordance with 10 CFR 26.75. Grand Gulf notified the NRC of this positive test result as well as their plan to reinstate the SRO of his licensed duties, pending the successful completion of both a substance abuse treatment program and a subsequent medical evaluation by the facilitys Medical Review Officer. By November 20, 2013, the SRO had satisfactorily completed all necessary evaluations and was granted unescorted access to the protected area, but was not allowed to perform licensed activities.

On December 5, 2013, the SRO participated in a FFD test which resulted in a second positive test result for a cocaine metabolite. Grand Gulf terminated the individual and requested the termination of the individuals license. On January 6, 2014, the NRC terminated the senior reactor operators license, retroactive to December 11, 2013. An investigation was initiated by the Office of Investigations and determined that the individual deliberately used cocaine while employed as a SRO at Grand Gulf. The staff has made several attempts to contact the individual and offer a predecisional enforcement conference, but the individual has been unresponsive.

Due to the individuals positive FFD test results on two separate occasions, and his deliberate actions related to drug use activities, the staff lack the requisite reasonable assurance that licensed activities can be conducted in compliance with the Commissions requirements and that the health and safety of the public will be protected if the individual were permitted at this time to be involved in NRC-licensed activities.

It should be noted that the individual has not been specifically informed of the enforcement action.
