The inspection was an examination of the activities conducted under your license as they relate to radiation safety and to compliance with the Nuclear Regulatory Commission (NRC) rules and regulations and the conditions of your license. 16. Scope and Observations:

This was an unannounced non-routine inspection of a tomato product factory in Elwood, Indiana, who possessed generally-licensed devices that required registration in accordance with 10 CFR 31.5(c)(13). The purpose of this non-routine inspection was to verify the status of the generally-licensed devices as the NRC had not been able to contact the licensee regarding its registration for 2021. At the time of the inspection, the licensee possessed and used three Industrial Dynamics (Filtec) FT-50 gauges containing 100 mCi americium-241 sealed sources to detect the fill level of food product bottles during the bottling process. According to the gauge label and registration, these devices are required to be tested for leakage at a periodicity not to exceed 3 years.

The inspector discussed the status of the licensee's registration with the Maintenance Scheduler. The licensee stated that the responsible individual on file with the NRC was no longer at the location, but that the Maintenance Scheduler recalled submitting the registration and paying registration fees for 2021. The licensee subsequently verified that fees had been paid and provided the registration information to ensure it was received by the NRC.

While the inspector was on-site, the inspector also toured the area of the licensee's facility where the gauges were installed to verify the licensee still possessed the gauges. On this tour, the inspector performed independent surveys and determined that dose rates around the gauges were indistinguishable from background. The inspector also reviewed the licensee's most recent gauge service records to verify the gauges were serviced and leak tested by a licensed entity.

No violations of NRC requirements were cited as a result of this inspection.
