Cardt ar.d l'r. Richard E. Condit on behalf of the Govern- :s racht Accountability Prcject (GAP). Director's Decision 00-88-3 denied a Petition filed by GAP under 10 CFR 2,206. In large part, the basis for the

, denial of the GAP Petition was er, evaluation perforined by the Safety Significance Assesstent Team, decur..ented in a report in which the staff concludes that allegations of safety concerns could not be substantiated. In its present request, G;P alleges that 00-E8-3 is not responsive to its Petition and is not based on substantici evider.ce, and is therefore arbitrary and capricious.

Specifically, GAP alleges that the NRC staff investigation of safety allegations was inherently inadequate to serve as a basis for any assessment of the progran,-

matic in.plications of the allegations.

GAP's request has been denied for the reasons fully described in the "Supplement To Director's Decision DD-88-3," issued on this date, which is available for public inspection at the Comission's Public Docurnent Room, Gelran Building, P120 L Street,!!.W., Washington, D.C. 20555, and the Loca*.

A copy of the Supplement will be filed with the Secretary for the Connission's review in accordance with 10 CFR 2.206(c). As provided in this regulation, Director's Decision 00-88-3 and the Supplement will constitute the final action of the Comission twenty five (25) days after issuance, unless the Comission en its own rnotion inttitutes review of the Decision and Supplement within that time.
