l l Introduction l

Pursuant to 10CFR50.90, Connecticut Yankee Atomic Power Company (CYAPCO) hereby proposes to amend its Operating License, DPR-61, by incorporating the  ;

attached proposed changes into the Haddam Neck Plant (HNP) Technical Specifications.

Backaround in a letter dated December 5,1996,W CYAPCO informed the NRC that the Board of Directors of CYAPCO had decided to permanently cease operations at the HNP and i

that the fuel had been permanently removed from the reactor.

l The changes proposed herein will relocate the requirements for a seismic monitor consistent with the gu'idance contained in Generic Letter 95-10 and in fulfillment of a commitment CYAPCO made to the NRC(2) from the technical specifications to a document which is controlled under 10CFR50.59.

-The material provided in Attachments 1 through 4, builds upon the May 30,1997 submittals(2- ) and License - Amendment No. 192, issued by the NRC on

- March 27,1998F whereby information that is not required to support a plant which has certified that fuel has been removed from the reactor. vessel and that had ceased -

operations may be removed from the technical specifications to allow for a ~more concerted effort on maintaining safe storage of the irradiated fuel.

- In support of this license amendment request, the following information is provided:

  • ' Attachment i forwards the marked-up Technical Specification pages.

  • Attachment 2 forwards the retyped Technical Specification pages.

. Attachment 3 describes the proposed Technical Specification changes.

.~ Attachment 4 provides a safety assessment for the proposed changes.

'CYAPCO has reviewed the proposed Technical Specification changes in accordance with 10CFR50.92. In addition, CYAPCO has determined that l

the changes do not involve a significant hazards consideration'(SHC).

- The basis for this determination is also discussed in Attachment 4.

Moreover, the Commission has provided guidance concerning the application of standards in-10CFR50.92 by providing certain examples (March 6,1986,51FR7751) of amendments that are not likely to involve an SHC. The proposed changes described in Attachment 3 are . not enveloped by a specific example. However, it has been ~

demonstrated (i.e., Attachment 4) that the proposed changes do not involve an SHC.

Environmental Consideration CYAPCO has reviewed the proposed license amendment against the criteria of 10CFR51.22 for environmental considerations The proposed changes do not involve an SHC, do not significantly increase the types and amounts of effluents that may be released off-site, and do not significantly increase individual or cumulative occupational radiation exposures. Based on the foregoing, CYAPCO concludes that the proposed changes meet the criteria delineated in 10CFR51.22(c)(9) for a categorical exclusion from the requirement of an environmeritalimpact statement.

Elant Operations Review Committee The Plant Operations Review Committee has reviewed this proposed amendment request and concurs with the above determination.

Nuclear Safety Assessment Board Review The Nuclear Safety Assessment Board has reviewed this proposed amendment request and concurs with the above determination.

State Notification In accordance with 10CFR50.91(b), CYAPCO is oroviding the State of Connecticut with a copy of this proposed amendment request.

Commitments There are no commitments contained within this letter.

Schedule Reauired for NRC Anorova!

CYAPCO requests that these proposed changes be reviewed and approved at the NRC Staff's earliest convenience and that the license amendment be effective upon issuance to be implemented within 60 days.

Conclusion The proposed changes have been reviewed in accordance with 10CFR50.92 and have been determined to not constitute an SHC. In addition, the proposed changes have ,

been reviewed against 10CFR51.22 and it has been determined that the proposed changes meet the criteria for a categorical exemption from requiring an environmental impact statement.
