Dear Chairman Jackson:

On behalf of the Licensing and Design Bases Clearinghouse,l' we are writing to request that the Camminion defer its final vote on SECY-97-036 until the public has had an opportunity to comment on the important related issues raised in Drafi NUREG-1606," Proposed Regulatory Guidance Related to Implementation of 10 C.F.R. 0 50.59 (Changes, Tests, or Experiments)." The issues raised in SECY 036, related to the Final Safety Analysis Report and current licensing basis, are closely intertwined with the issues in Drafi NUREG-1606.

  • Although SECY-97-036 was not published for public comment, the Commission's action on the document should take into account the related issues in NUREG-1606 in order to develop and foster consistent regulatory policy. Delaying a final vote on SECY-97-036 would allow the Conanission to address the related policy and regulatory issues set forth in the NUREG, in a comprehensive fashion.

'Ihe Staff Requirements Memorandum for SECY-97-035 directs that the Stafi prepare a paper for the Commission to consider the guidance in SECY 036 and the public comments on Draft NUREG-1606, with a recommendation for further improvements in the regulatory process. The Clearinghouse members agree with this course of action. Accordmgly, we believe it would be appropriate to defer 9
