ORDER (Denying Request for Reconsideration)
On September 4, 2008, petitioners Westchester Citizens Awareness Network, Rockland County Conservation Association, Promoting Health and Sustainable Energy, Sierra Club - North East Chapter, and Assemblyman Richard Brodsky (collectively, WestCAN) submitted a motion for reconsideration of the Commissions decision in CLI-08-19 (Aug. 22, 2008). In that decision, the Commission denied WestCANs petition to intervene, for failure to demonstrate standing.
WestCANs motion for reconsideration is deficient on its face in several respects.
First, it is untimely under the E-filing rules applicable to this proceeding. 10 C.F.R.
§§ 2.323(e); 2.302(a), 2.305(c), 2.306(c)(2). Second, WestCANs motion substantially exceeds the page limit prescribed for motions for reconsideration, and WestCAN has neither sought nor received permission from the Commission to exceed that limit. 10 C.F.R. § 2.323(e). Finally, WestCAN has neither sought nor received leave from the Commission to file a motion for reconsideration, nor addressed any compelling circumstance that would render the decision in CLI-08-19 invalid. 10 C.F.R. § 2.323(e).
For these reasons, pursuant to my authority under 10 C.F.R. § 2.346(c) and (j),
WestCANs motion is denied.
