U. S. Nuclear Regulatory Commission AEP-NRC-2013-21 Page 2 By Reference 1, as modified by Reference 2, Indiana Michigan Power Company (I&M), the licensee for Donald C. Cook Nuclear Plant Units 1 and 2, submitted proposed changes to Emergency Action Levels (EAL) to the U. S. Nuclear Regulatory Commission (NRC) for review and approval.
By Reference 3, the NRC approved the EAL Scheme and specified an implementation period.
By Reference 4, I&M notified the NRC that the EAL Scheme approved by Reference 3 did not satisfy the requirements of 10 CFR Part 50 Appendix E and that I&M planned to submit a License Amendment Request (LAR) proposing changes to the EAL Scheme.
By Reference 5, I&M submitted a LAR proposing changes to the EAL Scheme, previously approved by Reference 3, that satisfied the requirements set forth in 10 CFR 50, Appendix E.
During a telecom on February 8, 2013, I&M expressed to the NRC that I&M would be requesting to withdraw the LAR proposed changes to the EAL Scheme (Reference 5).
This also requires withdrawal of the EAL Scheme request that was approved, but not yet implemented. Therefore, I&M would like to request withdrawal of the original request for changes to the EAL Scheme (Reference 1), which was modified by Reference 2, and the subsequent LAR submitted on December 3, 2012 (Reference 5). The EAL Scheme change request and subsequent LAR were discretionary and not required to meet any regulatory requirement or commitment. The current EAL Scheme for CNP continues to satisfy regulatory requirements.
