Description | The inspectors identified a Severity Level IV, Non-Cited Violation of 10 CFR 50.71(e) for the self-revealed failure to update the Final Safety Analysis Report (FSAR) to assure that the information in the report was the latest information developed and contained all changes necessary to reflect information and analyses submitted to the NRC. This finding was self-revealed following the inspectors identification of numerous FSAR inaccuracies concerning licensee responses to generic docketed correspondence to the commission. This was further corroborated by a follow-up licensee self-assessment and streaming analysis. As a result, the licensee initiated a root cause evaluation which also identified the failure to update the FSAR in response to licensee credited actions, new NRC regulations, programmatic licensee commitments, and certain license amendment safety evaluation reports. The inspectors determined that a primary cause of the finding was related to the cross-cutting element of human performance due to the failure to have processes and procedures to maintain the current licensing basis and a lack of knowledge by plant staff of regulatory requirements. The licensee has taken immediate remedial corrective actions to address several issues, including the development of a site policy and procedures that defined the current licensing basis. In addition, the licensee has planned comprehensive corrective actions, including a detailed project scope to update the FSAR. Because violations of 10 CFR 50.71(e) affect the NRCs ability to perform its regulatory function, this finding was evaluated using the traditional enforcement process. In accordance with the NRC Enforcement Policy, this finding is determined to be more than minor because a failure to update the FSAR could have had a material impact on safety or licensed activities. This finding has been reviewed by NRC management and is determined to be a Green finding, of very low safety significance. |
