Items of Interest Week Ending October 15, 2021 NRC Issues Exemption for Work Hour Controls related to the COVID-19 Public Health Emergency On October 13, the U.S. Nuclear Regulatory Commission granted an exemption (Agencywide Documents Access and Management System Accession No. ML21265A438) to Exelon Generation Company, LLC for Peach Bottom Atomic Power Station, Units 2 and 3, from specific requirements of Title 10 of the Code of Federal Regulations Part 26, Fitness for Duty Programs, Section 26.205, Work hours. This exemption is related to work hour controls for certain personnel or groups of personnel as a result of the COVID-19 public health emergency. The staff reviewed the proposed exemption and determined the exemption is authorized by law, will not endanger life or property or the common defense and security, and is otherwise in the public interest.

Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending October 15, 2021 NMSS Staff Approved Alternate Disposal of Calcium Fluoride Waste On October 12, 2021, the staff approved the Westinghouse Columbia Fuel Fabrication Facility request for alternate disposal of specified Calcium Fluoride waste material to the US Ecology, Inc (USEI) Resource Conservation and Recovery Act Subtitle C disposal facility located near Grand View, Idaho. Westinghouse was granted a license amendment and exemption to transfer the material (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML21214A093), and the USEI was granted an exemption to receive the material (ADAMS Accession No. ML21208A151). These licensing actions were effective on the approval date October 12.

NMSS Staff Approved One-time Extension for Conducting the Biennial Emergency Exercise On October 14, 2021, the staff approved the request by Louisiana Energy Services, LLC, doing business as URENCO, USA (UUSA), for a one-time extension for conducting the 2021 biennial evaluated emergency exercise for its fuel fabrication facility located in Wilmington, North Carolina (ADAMS Accession No. ML21277A150). UUSA requested this exemption because the local COVID-19 conditions prevent them from safely conducting the biennial exercise as planned. The emergency exercise must be held by October 9, 2022.

NMSS Staff Made Presentations at the Fall Low-Level Radioactive Waste Forum On October 13-14, 2021, the U.S. Nuclear Regulatory Commission (NRC) presented virtually at the Fall Low-Level Radioactive Waste Forum held in Denver, Colorado. The NRC staff presented an update on the low-level waste regulatory framework (including programmatic assessment, current rulemakings, the Uniform Waste Manifest revision, and very low-level waste developments); decommissioning process improvements; NRCs response to the COVID-19 pandemic; and NRCs environmental justice review efforts.
